AN ORDINANCE ANNEXING CERTAIN PROPERTY
TO THE VILLAGE OF ELIC GROVE VILLAGE
(FOUR COLUMNS. LTD.-STOVALL)
WHEREAS, a written Petition has been filed with
the Village Clerk of the Village of Elk Grove Village
by Maywood - Proviso State Bank as Trustee under Trust
No. 3959, dated May 14, 1976, being the Record Owner
of the hereinafter described land and territory and Cindy
Nevarez and Andy Niziolek being the sole electors residing
on said territory, said Petition seeking annexation to
the Village of Elk Grove Village; and
WHEREAS, said land and territory is not within
the corporate limits of any municipality, but is contiguous
to the Village of Elk Grove Village and the only elector
residing on the property are signatories to the Petition
for Annexation; and
WHEREAS, any Fire Protection District, Library
District, Township Road Commissioner, or 'other entity
or person entitled to notice prior to annexation of the
subject property has been given such notice as is required
by law; and
WHEREAS, all statutory requirements in reference
to the annexation have been fully complied with and the
Village President and Board of Trustees believe it to
be in the best interest of the Village that said land
and territory be annexed thereto;
NOW, THEREFORE, BE IT ORDAINED by the President
and Board of Trustees of the Village of Elk Grove Village,
Cook and DuPage Counties, Illinois as follows:
Section 1: That the following land and territory,
which territory is contiguous to the Village of Elk Grove
Village and not within the limits of any other munici-
pality, be and the same is hereby annexed to the Village
of Elk Grove Village, so that said territory be included
within the boundary limits of said Village as is by law
in such case made and provided:
Lots 1 and 2 in EMMA KRUEGER'S SUBDIVISION
of a part of the North half of the Northeast
Quarter of Section 3 and a part of the
Northeast Quarter of the Northeast Quarter
of Section 4, Township 40 North, Range
11 East of the Third Principal Meridian,
according to the plat thereof recorded
September 16, 1948 as Document No. 554217;
together with that part of the North
50 feet of the said North half of the
Northwest Quarter of Section 3 lying
Westerly of a Northward prolongation
of the East line of said Lot 1 and lying
Easterly of a Northward prolongation
of the West line of said Lot 2, all in
DuPage County, Illinois.
Section 2: That all requisite filing fees due
upon petitioning for annexation have been paid to the
Village and the Owner or successor in interest to the
Owner shall pay in addition the sum of Five Thousand
($5,000.00) Dollars to the Village's Municipal Purpose
Fund upon annexation as is required by Village Ordinance.
Section 3: That said property shall be zoned
I-1 Industrial, which zoning is the classification assigned
to the subject property on the official map of the Village.

Section 4: That subsequent to the annexation
of said property, the Owner agrees that it shall enter
into an Agreement with the Village of Elk Grove Village
and the Metropolitan Sanitary District for the purpose
of providing sanitary sewer service to the subject property.
Section 5: That the Village Clerk of the Village
of Elk Grove Village is directed to record a certified
copy of this Ordinance, together with a Plat of Annexation
of said territory, with the Recorder of Deeds of DuPage
County, Illinois.
Section 6: That the Petitioner shall reimburse
the Village of Elk Grove Village for all costs attributable
for the recordation of documents with the DuPage County
Recorder's Office and the publishing of all required
legal notices and ordinances.
Section 7: That this Ordinance shall be in full
force and effect from and after its passage and approval
according to law.
