HomeMy WebLinkAboutORDINANCE - 1736 - 7/23/1985 - ZONING ORDINANCE AMENDEDORDINANCE NO. 1736 AN ORDINANCE AMENDING ARTICLE V OF THE ZONING ORDINANCE OF THE VILLAGE OF ELK GROVE VILLAGE BY PROVIDING FOR THE WAREHOUSING AND DISTRIBUTION OF GOODS, PRODUCTS AND SUPPLIES AS A SPECIAL USE IN THE BUSINESS ZONED DISTRICTS OF THE VILLAGE WHEREAS, the Plan Commission of the Village of Elk Grove Village at a public meeting duly called and held according to law considered the question of amending the Zoning Ordinance of the Village to provide for the warehousing and distribution of goods, products and supplies as a special accessory use; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village after having reviewed the findings of said Plan Commission find and believe it to -be in the best interest of the Village that the Zoning Ordinance be so amended; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Article V of the Zoning Ordinance of the Village of Elk Grove Village be and the same is hereby amended by adding Secs. 5.42.F, 5.52.F and 5.62.F, and by adding to Sec. 5.72.E the following: (5.42.F, 5.52.F, 5.62.F, 5.72.E) SPECIAL USE Warehousing and distribution of goods, products, and supplies provided such use is an accessory use to a permitted use within the District. .If the permitted use consists of an office or a place of business engaged in part in the warehousing and distribution of goods, products and supplies, warehousing and distribution shall be considered an accessory use. The following conditions and procedures shall be required as a minimum for such special use to be granted: 1. The use proposed must be of the type and so located as to exercise no detrimental influence upon the surrounding properties. 2. The application for the Special Use shall be accompanied by a preliminary site plan for the property showing the location of all existing or proposed buildings, driveways, parking areas, and loading docks. 3. If required by the Plan Commission, a traffic study shall be prepared as a part of the Special Use Application, and such requirements as may be determined by the Plan Commission to be necessary or appropriate as a result of the findings of the traffic study, may be incorporated in the Special Use Permit. 4. All storage shall be inside. 5. Not more than forty (40%) percent of the floor area of the building may be utilized for warehousing and distribution. 6. Shipments of goods, products and supplies may be broken down and repackaged for warehousing and distribution purposes. 7. All loading docks used for the warehousing and distribution of goods, products and supplies shall be landscaped or otherwise screened in a manner approved by the Plan Commission. 8. No motor freight terminals or other prohibited uses shall be permitted as a part of the special use. -2- Section 2: .Any- .person, firm or.corporation who violates, disobeys, omits, neglects or refuses to comply with, or who resist.the enforcement of any of the provisions of this Ordinance shall, upon conviction thereof, be fined not less than Five ($5.00) Dollars nor more than Five Hundred ($500.00) Dollars for each and every offense. A separate offense shall be deemed committed on each day a violation occurs or continues. Section 3: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 4 NAYS: 0 ABSENT: 2 APPROVED: Charles 1.
