HomeMy WebLinkAboutORDINANCE - 1749 - 9/24/1985 - BOULEVARD CORP• :45111 M • •' 1 1 I• M 15 1 1 1we)•J• 1 M 1 I• / • 71'•V' 1 1 • I I } 1 ' • 1 • tl• • • 'I• `1 'l / •' 1 / /• M '• 7/ x71 / 1 I 1 1 1 M 1 • '•M 01' V' � • 1 • •• • •� •1 1 ' I LM • • 1 WHEREAS, on February 12, 1985 the President and Board of Trustees of the Village of Elk Grove Village adopted Ordinance No. 1703 annexing and rezoning the Boulevard Corporation property to the Village of Elk Grove Village and Ordinance No. 1704 granting a Special Use Permit for said property and Ordinance No. 1734, adopted on July 23, 1985, extending the time in which the Contract Purchaser takes title to the subject property; and WHEREAS, as a part of the conditions and terms of said Ordinances, the Contract Purchaser was to provide evidence to the Village that it has taken title to the subject property of the annexation within six (6) months of the date of the adoption of the Ordinance; and WHEREAS, the Contract Purchaser has advised the Village that certain hardships have existed so as to delay securing adequate financing to comply with the above stated conditions; and WHEREAS, the Village of Elk Grove Village has been asked by the Contract Purchaser to consider an amendment to the above stated Ordinances thereby extending the time for Contract Purchaser to acquire title to the property; NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Section 6 of Ordinance No. 1703 duly passed and approved on the 12th day of February, 1985 be and the same is hereby amended to read as follows: Section 6: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law, provided the Contract Purchaser consummates the purchase of the subject property and takes title thereto and shows the Village evidence thereof. Should the Contract Purchaser fail to produce such evidence by December 31, L%5, then this Ordinance shall be dawned null and void. Section 2: That Section 8 of Ordinance No. 1704 duly passed and approved on the 12th day of February, 1985 be and the same is hereby amended to read as follows: Section 8: That this Ordinance shall be in full force and effect from and -after its passage, approval and publication accord- ing to law, provided: i. Contract Purchaser consummates the purchase of the subject property and takes title thereto and shows the Village evidence thereof, and ii. Contract Purchaser pays to the Village the sum of Eight Thousand Five Hundred ($8,500.00) Dollars for the municipal purpose fund, which is due pursuant to the Ordinances of the Village for the annexation of the property. Should the Contract Purchaser fail to produce such evidence or to pay the Eight Thousand Five Hundred ($8,500.00) by December 31, 1985, then this Ordinance shall be deered null and void. -2- Section 3: That this Ordinance shall be in full force and effect from and after its passage and approval according to law.
