HomeMy WebLinkAboutORDINANCE - 1750 - 9/24/1985 - ANNEXING & REZONING PROPERTYNO. 1750 AN ORDINANCE ANNEXING AND REZONING CERTAIN PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE (LOCAL 512 REALTY CORP.) WHEREAS, a written Petition has been filed with the Village Clerk of Elk Grove Village by Local 512 Realty Corp., Owner of Record of the hereinafter described land and terri- tory, said Petition being for annexation to the Village of Elk Grove Village; and WHEREAS, said land and territory is not within the Corporate Limits of any municipality but is contiguous to the Village of Elk Grove Village and has no electors residing thereon; and WHEREAS, all applicable provisions of the Illinois Revised Statutes pertaining to annexation and requisite notice therefor have been complied with and adhered to; and WHEREAS, the Plan Commission of the Village of Elk Grove Village, acting as a Zoning Commission, conducted a public hearing duly called and held according to law to consider the question of annexing and rezoning said property to the Village of Elk Grove Village; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove village, Counties of Cook and DUPage, Illinois after having examined said Petition to annex and the findings of said Plan Commission find and believe it to be in the best interest of the Village that said land and territory be annexed to the Village of Elk Grove Village and rezoned 0-T, Office Transitional District. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the land and territory described in Exhibit A attached hereto and incorporated herein, which territory is contiguous to the Village of Elk Grove Village and is not within the limits of any municipality, be and the same is hereby annexed to the Village of Elk Grove Village. Section 2: That said property shall, upon annexation, be zoned 0-T Office Transitional, in accordance with the findings of the Plan Commission upon a Petition for rezoning by the Owner so that hereafter said territory shall be included within the boundary lines and limits of said Village of Elk Grove Village, as is by law in such cases made and provided. Section 3: That concurrent with the annexation, there is hereby granted a fifty-five (551) foot side yard variation on the West side of the subject property. Section 4: That notwithstanding the granting of the 0-T Office Transitional Zoning as incorporated herein, the Village may, within six (6) months of the date hereof, petition the Plan Commission for the purpose of rezoning the property from O -T to B-2 business. Should the Village -2- cause the property to be rezoned to B-2 business district, then and in that event there is hereby granted a twenty (20') foot variation of Section 5.1 of the Zoning Ordinance as it pertains to minimum lot width at front yard line, and the side yard variation as granted in Section 3 shall remain in full force and effect. Section 5: That the Village Clerk of the Village of Elk Grove Village is hereby directed to record a certified copy of this Ordinance together with an accurate Plat of Annexation of said territory with the Recorder of Deeds of Cook County, Illinois and is further directed to amend the Zoning Map of the Village in accordance with the pro- visions hereof and to file such Notice of Annexation as is required by law. Section 6: That the annexation of the property herein is subject to the condition that the Owner comply with Recapture Ordinance 878 which Ordinance requires a payment of Five Hundred Fifty ($550.00) Dollars per acre to the Village of Elk Grove Village for water and sewer main extensions from Walnut Lane; that the Owner comply with Resolution 25-76 requiring a Six Thousand Four Hundred ($6,400.00) Dollar payment to an abutting property owner for the extension of water and sewer from the VFW property to the Putt -Putt Golf Course; payment to the Village Municipal Purpose Fund an amount of Six Hundred Ten ($610.00) Dollars. -3- Section 7: That the Village Clerk is hereby directed to publish this Ordinance in pamphlet form. Section 8: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES• 5 NAYS: 0 ABSENT: 1 APPROVED: Charles J.
