HomeMy WebLinkAboutORDINANCE - 1672 - 9/25/1984 - SITE PLAN AMENDEDORDINANCE NO. 1672 AN ORDINANCE AMENDING ORDINANCE 1195 ADOPTED DECEMBER 13, 1977 BY AMENDING A SITE PLAN FOR PROPERTY LOCATED NORTH OF LANDMEIER ROAD ADJACENT TO PERRIE DRIVE IN ELK GROVE VILLAGE WHEREAS, the Village of Elk Grove Village pursuant to Ordinance No. 1195 adopted an Annexation Agreement which incorporated therein a Site Plan pertaining to, inter alia, the number of dwelling units in total, the number of three bedroom dwelling units, the percentage of two and one bedroom dwelling units and the number of buildings; and WHEREAS, the successor in interest to the original annexing party,Shelter Real Estate has requested a change in the Site Plan as it pertains to the South one-half (1/2) of said subject property; and. WHEREAS, the Plan Commission of the Village of Elk Grove Village at a public meeting duly called and held according to law considered the question of amending said Annexation Agreement to incorporate changes into the Site Plan with respect to the areas above set forth; and WHEREAS, the President and Board of Trustees after having reviewed the findings of said Plan Commission find and believe it to be in the best interest of the Village to amend the Annexation Agreement; NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Ordinance No. 1195 duly passed and approved on December 13, 1977 be and the same is hereby amended by substituting therein a Revised Site Plan dated June 1, 1984 and revised August 20, 1984, which Site Plan amends the original Site Plan as follows: A: Increases the number of dwelling units from ninety-six (96) to one hundred four (104). B: Eliminates nine (9) three bedroom units. C: Adds eight (8) studio units. D: Alters the percentage of two bedroom and one bedroom units. E: Reduces the square footage by approximately eleven (118) percent. F: Reduces the number of buildings from six (6) to four (4). A copy of said Site Plan is on file with the Village Clerk and is hereby incorporated by reference. Section 2: That the Village Clerk is hereby authorized to record a copy of this amendment to the Annexation Agreement with the Cook County Recorder of Deeds and is further authorized to attach a legal description of said property as Exhibit A hereto. Section 3: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 4: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. - 2- VOTES: AYES: 6 NAYS: ABSENT: I I APPROVED: Charles J. PUBLISHED this 3rd day of October 1984, in pamphlet form in the Elk Grove Daily Herald. - 3 - TO BE PUBLISHED OCTOBER 3, 1984 ORDINANCE NO. 1672 An Ordinance Amending Ordinance 1195 Adopted December 13, 1977 by Amending a Site Plan for Property Located North of Landmeier Road Adjacent to Perrie Drive in Elk Grove Village was duly adopted by the President and Board of Trustees on September 25, 1984. Said Ordinance has'been published in Pamphlet Form pursuant to the authority of the President and Board of Trustees, Village of Elk Grove Village, Cook and DuPage Counties, Illinois. Copies are available at the Village Clerk's Office, Municipal Building, 901 Wellington Avenue, Elk Grove Village, Illinois. ORDINANCE NO. 1195 AN ORDINANCE AMENDING THE SITE PLAN ADOPTED BY RESOLUTION NO. 56-70 AND GRANTING A SPECIAL USE PERMIT FOR THE REGENCY SQUARE DEVELOPMENT WHEREAS, the President and Board of Trustees by Resolution No. 56-70 adopted June 23, 1970, authorized the execution of an Annexation Agreement with the owners of certain real estate described in Exhibit A thereto; and WHEREAS, the successors -in -interest to the original owners and developers of said real estate are desirous of developing said property in a manner substantially different from that originally approved; and WHEREAS, said major change in the site plan was submitted to the Plan Commission of the Village of Elk Grove Village for public hearing and pursuant to said public hearing, it was the recommendation of said Plan Commission that the Village of Elk Grove Village grant a special use permit in the A-2 zoned district, subject to certain conditions as set forth in the finding of fact of the Plan Commission; and WHEREAS,, said conditions requested by the Plan Commission and such other conditions requested by the Village Administration are set forth in an amended Annexation Agreement between the successors -in - interest and the Village of Elk Grove Village, which amended Annexation Agreement was duly executed, pursuant to Resolution by the President and Board of Trustees of the Village of Elk Grove Village; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village deem it to be in the best interests of the Village that such special use permit be granted. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois, as follows: Section 1: That there be granted a special use permit in accordance with Section 5.36 of the Zonina Ordinance of the Village of Elk Grove Village for real estate zoned A-2 and legally described in the site plan attached hereto and by this reference incorporated herein r to the Bianco Development Company and the Elk Grove Development Company, subject to the following conditions: (A). That the owners adhere to all of the conditions and agreements as set forth in the amended Annexation Agreement between said owners and the Village of Elk Grove Village dated December 13, , 1977. (B). That the development will be built in substantial conformance with the site plan attached hereto and incorporated herein. Section 2: That the Village Clerk is hereby directed to publish this Ordinance in pamphlet form.
