HomeMy WebLinkAboutORDINANCE - 1686 - 12/11/1984 - ZONING VARIATION/1901 & 1955 ESTESNO. 1686 AN ORDINANCE GRANTING A VARIATION OF SEC. 5.1 OF THE ZONING ORDINANCE OF THE VILLAGE OF ELK GROVE VILLAGE AS IT APPLIES TO MINIMUM REQUIRED SIDE YARDS TO PERMIT THE CONSTRUCTION OF ONE (1) CONNECTING LINK BETWEEN PROPERTY LOCATED AT 1901 ESTES AVENUE AND 1955 ESTES AVENUE, ELK GROVE VILLAGE WHEREAS, the Zoning Board of Appeals of the Village of Elk Grove Village at a public meeting duly called and held according to law considered the question of granting a variation of Sec. 5.1 of the Zoning Ordinance of the Village of Elk Grove Village to permit the construction of a connecting link between property located at 1901 Estes Avenue and 1955 Estes Avenue and legally described hereinafter; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village after having reviewed the findings of said Zoning Board of Appeals find and believe that sufficient hardship exists so as to warrant the granting of said variation; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a variation of Sec. 5.1 of the Zoning Ordinance of the Village of Elk Grove Village to the National Boulevard Bank of Chicago as Trustee under Trust Agreement dated January 30, 1963 and known as Trust No. 1199 (owners of record) and Jerry J. Jacobson and Arthur Wolfe to permit the construction of a connecting link between property located at 1901 Estes.Avenue and 1955 Estes Avenue, Elk Grove Village and legally described as follows: Lot 26 (except the west 735.0 feet thereof and except the East 1344.0 feet, as measured along the South line thereof) in Centex Industrial Park Unit 5, being a Subdivision in Section 35, Township 41 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois. Section 2: That this variation is subject to the condition that the variation shall terminate upon the sale of one or both of the subject buildings and that the connecting link be removed and the property restored to its present condition, unless a new variation is granted to the subsequent purchaser or owner. This condition is binding on the owner and all assigns, purchasers, or successors in interest of the owners. Section 3: That the Village Clerk is hereby directed to record this Ordinance with the Cook County Recorder of Deeds and is further directed to publish this Ordinance in pamphlet form. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. -2- VOTES: AYES: 4 NAYS: 0 ABSENT: 2 ATTEST: Patricia S. Said Ordinance has been published in Pamphlet Form pursuant to the authority of the President and Board of Trustees, Village of Elk Grove Village, Cook and DuPage Counties, Illinois. Copies are available at the Village Clerk's Office, Municipal Building, 901 Wellington Avenue, Elk Grove Village, Illinois.
