AN ORDINANCE GRANTING SPECIAL USE PERMIT
NO. 2 TO CENTEX HOMES MIDWEST, INC. FOR
APPROXIMATELY EIGHTY-FIVE (85) ACRES OF PROPERTY
LOCATED IN SECTION 23B, ELK GROVE VILLAGE
WHEREAS, the Plan Commission of the Village of Elk
Grove Village at a public meeting duly called and held
according to law considered the question of granting a
second Special Use Permit to Centex Homes Midwest Inc.,
thereby permitting certain property presently zoned R-3
Residential, to be developed under the Special Use Provisions
of Sec. 5.25a of the Zoning Ordinance of the Village of
Elk Grove Village; and
WHEREAS, the President and Board of Trustees of the
Village of Elk Grove Village after having considered the
recommendations of said Plan Commission find and believe
it to be in the best interest of the Village that said
Special Use Permit be granted;
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Elk Grove Village,
Counties of Cook and DuPage, Illinois as follows:
Section 1: That there be granted Special Use Permit
No. 2 to Centex Homes Midwest Inc., on property legally
described on Exhibit A, attached hereto, to permit the
development of single family detached units pursuant to
the provisions of Sec. 5.25a of the Zoning Ordinance of
the Village of Elk Grove Village.
Section 2: That the Subdivision Control Ordinance
of the Village of Elk Grove Village be and the same is
hereby amended to permit the following development within
said Special Use area:
1. The local street right-of-way shall have
a minimum requirement of fifty (50) feet.
2. The ends of all cul-de-sacs shall have a
minimum radius of forty-five (45) feet.
3. The location and number of street trees shall
be as approved by the Village but in no event
shall the number of said trees be less than the
equivalent presently required under the Subdivision
Control Ordinance.
Section 3: That the Special Use Permit herein granted
is further subject to the following requirements:
1. All open spaces depicted on the Plat of Survey
of the subject property, which survey is on file
in the Office of the Village Clerk and is hereby
adopted by this reference and incorporated herein,
shall be conveyed to the Village for subsequent
conveyance to the Park District.
2. The two (2) walkways depicted on the Plat
leading to the open space shall be improved with
four (4) foot wide concrete sidewalks by the
Developer upon request by the Park District.
3. That that portion of Gibson Drive within
the subject property be designated a Residential
Collector Street.
Section 4: That the Village Clerk is hereby authorized
to publish this Ordinance in pamphlet form.
Section 5: That this Ordinance shall be in full force
and effect from and after its passage, approval and publica-
tion according to law.
