AN ORDINANCE AMENDING CHAPTER 24A,
SETTLEMENT OF PENALTIES OF THE MUNICIPAL
CODE OF THE VILLAGE OF ELK GROVE VILLAGE
BE IT ORDAINED, by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois as follows:
Section 1: That Article I, Authorization and Procedure
of Chapter 24A of the Municipal Code of the Village of Elk
Grove Village be and the same is hereby amended to read as
follows:
ARTICLE I - SETTLEMENT OF MISCELLANEOUS OFFENSES -
POLICE DEPARTMENT
24A.101 - Parking Violations. Whenever a peace officer
is authorized to arrest a person without a warrant or
otherwise observes a violation of Article V of Chapter
14 of this Municipal Code (Parking Rules), said officer
shall issue a "P" ticket in such form as authorized by
the Office of the Clerk of the Circuit Court of Cook
County, setting forth the nature of the violation, and
the date, time and location wherein the violation occurred
and shall issue same by personal delivery to the vehicle
operator, if present, or attaching same to the motor
vehicle.
The registered owner or operator of any vehicle who
receives a "P" ticket may settle and compromise the
penalty arising from same by paying to the Finance
Department the following settlement amounts:

Final Notice Date to Court Assignment Date $15.00
Court Assignment Date to Court Date $30.00
Any person, firm or corporation who fails to settle or
compromise any "P" ticket as set forth herein and who
fails to appear in Court will be subject to having a
judgment entered in the amount of One Hundred ($100.00)
Dollars for each offense. Any person for whom judgment
is entered may settle and compromise said judgment by
appearing before the Clerk of the Circuit Court, Third
Municipal District in Niles, Illinois within ninety (90)
days from the date judgment is entered and paying a fee
of Forty-five ($45.00) Dollars for each citation.
24A.102 - Settlement of Certain Non -parking Vehicular
Whenever a peace officer is authorized to arrest a person
without a warrant or otherwise observes a violation of
any of the hereinafter designated sections of the Municipal
Code, said officer may issue a "PV" ticket in such form as
authorized by the Chief of Police, which "PV" ticket may
be settled and compromised as hereinafter set forth.
The "Pv" ticket shall set forth the nature of the
violation and the date, time and location wherein the
violation occurred and shall be personally delivered
to the alleged violator along with a notice advising
the violator of the settlement procedure and costs
associated therewith.
The "PV" ticket shall apply to violations of the
following sections of the Municipal Code:
Section Offense
14A-3-413 Display of registration plates,
registration stickers
14A-3-701 Operation of vehicles without
evidence of registration
14A-3-703 Operation of vehicle when registra-
tion cancelled, suspended, or revoked
14A-6-101 Valid driver's license or permit
14A-6-104 Classification of driver - special
restrictions
14A-6-116 Notice of change of address or
name
14A-12-201 through Equipment violations
14A-12-902
14A-13-111 Operation without certificate of
safety attached
15-15.002 Village Vehicle License
17-17.201 Animal License
18-18.201 Business License
Any person, firm or corporation issued a "PV" ticket
may settle and compromise same within ten (10) days from
the date of issuance by going to the Police Department
of the Village of Elk Grove Village with proof of
compliance of the violation cited and the payment of a Ten
($10.00) Dollar administrative fee, or mail an Affidavit
of Compliance with the Ten ($10.00) Dollar fee to the
Police Department if the violator is unable to make a
personal appearance. Any person, firm or corporation
issued a "PV" ticket and who has not settled and compromised
same within twenty (20) days, may do so within thirty
(30) days from the date of the issuance of the citation
by following the procedure set forth above and adding
thereto a late payment fee of Five ($5.00) Dollars.
Any person who does not settle or compromise the "PV"
ticket within the above stated period shall be processed
with the filing of a Complaint or Notice to Appear requiring
the violator's appearance in Court.
24A.103 - Other Offenses. Whenever a peace officer observes
a violation where the offender is not present at the time
of the violation or where the situation is such that the
issuance of a citation requiring the posting of bond is
impractical, then and in that event, the officer may
issue or cause the issuance of a "P" ticket to the alleged
offender. Said "P" ticket may permit the offender or
violator to settle and compromise the violation by paying
the minimum fee set forth in the Municipal Code for such
offense. Any person who fails to settle or compromise said
ticket within the time provided shall be subject to pro-
cessing as set forth in Sec. 24A.101 or by the issuance
of a Complaint or Notice to Appear requiring the violator's
appearance in Court.
Section 2: That the Village Clerk is hereby authorized
to publish this Ordinance in pamphlet form.
Section 3: That this Ordinance shall be in full force
and effect from and after its passage and approval as provided by
law.
