HomeMy WebLinkAboutORDINANCE - 1608 - 11/22/1983 - ZONING ORDINANCE AMENDEDORDINANCE NO. 1608 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF ELK GROVE VILLAGE BY PROVIDING FOR CONDITIONAL USES IN THE B-3 ZONED BUSINESS DISTRICT WHEREAS, the Plan Commission of the Village of Elk Grove Village acting as a Zoning Board at a public meeting duly called and held according to law considered the question of amending the Zoning Ordinance of the Village as it pertains to permitted and conditional uses in the B-3 Zoned Business District; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village after having considered the recommendation of said Plan Commission find and believe it to be in the best interest of the Village that the Zoning Ordinance be so amended; NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Paragraph B of Section 5.62, Permitted Uses in the B-3 Automotive Orientated Business District, be amended by deleting therefrom the following subparagraphs: (2) auto, truck and equipment sales and rental; (3) auto laundries or car washes; (5) commercial parking lots for private vehicles; (9) mobile home and trailer sales and rental, but not including the use of mobile homes as residences; (10) motels; (14) equipment sales, rental and services. So that said paragraph, as amended, shall read as follows: 5.62. B. Permitted Uses. (1) Ambulance Service. (2) Automobile Service Stations. (3) Drive -In Banks. (4) Restaurants including drive-in establishments serving food or beverage for consumption outside the structure. (5) Garden Stores and Gift Shop's. (6) Indoor places of entertainment and amusements. (7) Undertaking Establishments. (9) Public Utility Stations. (9) Uses permitted in B-1 and B-2 Districts. Section 2: That Paragraph D of Section 5.62 of the Zoning Ordinance be amended by adding thereto the following: 2. Additional Conditional Uses Permitted subject to the conditions set forth in Paragraph (E) below: (a) auto, truck and equipment sales and rental; (b) auto laundries or car washes; (c) commercial parking lots for private vehicles; (d) mobile home and trailer sales and rental, but not including the use of mobile homes as residences; (e) motels; (f) equipment sales, rental and services. Section 3: That Section 5.62 of the Zoning Ordinance be further amended by adding thereto a new paragraph which shall read as follows: - 2 - E. fir, -16 (Inir.it(•^ roI ('ondi1,i(mnl ll:; •s I;:;t,(I)I i:; Ili "I i.n Section 5.62 D.2. (1) A B-3 conditional use shall only be permitted if it is fronting on one of the industrial located major arterial streets listed below or if it is adjacent to another B-3 conditional use. (a) Higgins Road; (b) Oakton Street East of Lively Boulevard; (c) Landmeier Road East of Lively Boulevard; (d) Devon Avenue East of Tonne Road; (e) Busse Road; (f) Elmhurst Road. (2) Provisions for parking are in accordance with Section 3.9 of the Zoning Ordinance. (3) An approved plan for ingress and egress - said approval to take the form of a certificate signed by the Chiefs of Police and Fire Department and the Village Engineer, certifying that the plan for ingress and egress, proposed by the user, will not interfere with highway traffic, nor increase the risk of danger to persons or property. (4) Any conditional use granted herein may be located adjacent to or in the same building as other B-3 uses and I-1 and I-2 uses. Section 4: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 5: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 6 NAYS: 0 ABSENT: 0 APPROVED: Charles J.
