HomeMy WebLinkAboutORDINANCE - 1640 - 5/8/1984 - SUBDIVISION AMENDED1A 0 ORDINANCE NO. 1640 AN ORDINANCE AMENDING CHAPTER 8, SUBDIVISIONS, OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE BY ADDING THERETO PROVISIONS FOR THE CONTROL OF SOIL EROSION AND SEDIMENTATION. WHEREAS, excessive erosion and sedimentation of soil from areas undergoing development endangers the health and safety of highway users; necessitates the costly repair of gulleys and embankments; clogs sewers and ditches and pollutes rivers, lakes and streams; limits the use of waterways for most beneficial purposes; and reduces the channel capacity of waterways; and WHEREAS, the question of amending the Subdivision Control Ordinance to include provisions for the control of soil erosion and sedimentation was reviewed by the Plan Commission of the Village of Elk Grove Village; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village concur with the Plan Commission and are of the opinion that it is in the best interest of the Village that soil erosion and sedimentation requirements be adopted; NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Cook and DuPage Counties, Illinois, as follows: Section 1: That Chapter 8, Subdivisions, of the Municipal Code of the Village of Elk Grove Village be and the same is hereby amended by renumbering the present Section 8.017 Penalty to 8.018 and creating a new Section 8.017, which Section shall read as follows: 8.017 Soil Erosion and Sedimentation Control A. General 1. Purpose - The purpose of this Section is to diminish threats to public health and safety, reduce property damage and prevent the despoilation of the environment by regulating and controlling the design, construction, use and maintenance of developments and other activities which disturb or break the topsoil or otherwise result in the movement of earth on land situated in the Village of Elk Grove Village. 2. Applicability - Soil erosion and sedimentation control measures meeting the criteria and requirements established herein are required for the following: a. All subdivisions and/or developments having an area of one acre or more. b. Any lot or area regardless of size if deemed necessary by the Village Engineer in situations where property damage or despoilation develops or is likely to occur. 3. Specifications - All design and construction shall be done in accordance with the latest Edition of the standards contained in the "Procedures and Standards for Urban Soil Erosion and Sedimentation Control" prepared by the Northeastern Illinois Soil Erosion and Sedimentation Control Steering Committee. B. Design and Operation Standards and Requirements The following rules shall govern the design and construc- tion of land improvements with respect to soil erosion and sedi- mentation control. 1. Soil erosion and sedimentation control measures shall be provided to prevent the transportation of sediment from the site by a storm event of ten year frequency or less. 2. Prior to the commencement of stripping or grading operations, sediment basins, debris basins, desilting basins or silt trays or other appropriate control measures shall be installed and maintained at points of stormwater outflow from the site. -2- 4 3. The smallest practical area of land shall be exposed at any given time during develop- Imnt. 4. Temporary vegetation, or where appropriate, mulching or other non-viahle cover shall be used to protect areas exposed during development. 5. Permanent, final plant covering or structures shall be installed no later than 60 days after completion of final grading of any part of the site, unless otherwise approved by the Village Engineer. C. Submittal Requirements Acc=panying the final engineering plans of the subdivision, there shall be furnished the following information and data, in addition to that required by Section 8.005 of the Subdivision Control Ordinance. 1. Topographic map, drawn at no greater than two -foot contour intervals, portraying clearly the drainage pattern of the area and showing the location of existing structures, utilities, bodies of water, drainage facilities, vegetative cover, paved areas and other significant natural or man-made features on the site and adjacent land within approximately 100 feet of the site boundaries. 2. Development plan showing areas of excavation, grading and filling; proposed contours, finished grades, provisions for storm drainage; and areas to be paved, covered, sodded or seeded, vegetatively stabilized or left undisturbed. 3. An erosion and sedimentation control plan indicating: a. erosion and sedimentation control measures to be employed throughout all phases of construction and after completion of development of the site b. types of sod or seeding mixture and rate, expected dates of sodding or seeding, ground preparation, type and rate of fertilizer application, and kind and quality of mulching for both temporary and permanent vegetative control measures C. appropriate calculations used in sizing and determining the scope of the plan -3- d. provisions for maintenance of control facilities e. identification of the person(s) or entity which will have legal responsibility for maintenance of erosion control structures and measures after construction of the development is completed. 4. Schedule of site development operations including stripping and clearing, rough grading, installation of public improvements, building construction, final grading and landscaping. The schedule shall identify the expected date or dates of commencement of clearing, installation of temporary sediment control measures, installation of stormwater drainage facilities, street paving, parking lot paving, and planting of permanent vegetative cover. The schedule shall indicate the estimated duration of exposure of cleared areas. 5. The name, if known at the time of submittal, of the contractor(s) responsible for the installation of the control measures. D. Maintenance _ Persons carrying out the control measures under this Section and all subsequent owners of property where such measures have been taken, shall maintain all permanent erosion control measures, structures, plantings and other protective devices. E. Responsibility This Section shall not create liability on the part of the Village of Elk Grove Village or any officer or employee thereof for any condition or damage which may result from reliance on this Section or on any administrative decision law- fully made thereunder. F. Inspections The Village Engineer or his representative shall make inspections of the site while construction of the development is in progress. Where it is found by inspection that conditions are not substantially as stated or shown in the approved develop- ment plan, erosion and sedimentation control plan, and schedule of site development operations, the Village Engineer may stop further work until deficient conditions are corrected. -4- Section 2: That any person, firm or corporation who violates any of the provisions of this Ordinance shall be subject to a fine of not less than Twenty -Five ($25.00) Dollars nor more than Five Hundred ($500.00) Dollars for each offense, and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues to exist. Section 3: The Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: -5 NAYS: 1 ABSENT: 0 APPROVED: Charles J.
