HomeMy WebLinkAboutORDINANCE - 1648 - 6/12/1984 - ANNEXING PROPERTY/LAQUINTA MOTORORDINANCE•' NO. 1648 AN ORDINANCE ANNEXING CERTAIN PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE (LA OUINTA MOTOR INNS, INC.) WHEREAS, a written Petition has been filed with the Village Clerk of the Village of Elk Grove Village by Bill Anest, Peter Anest and First Arlington National Bank of Arlington Heights as Trustee under Trust Agreement dated November 26, 1979 and known as Trust No. A-1123 and La quinta Motor Inns, Inc., a Texas Corporation, being the Record Owners and Contract Purchasers respectively of the hereinafter described land and territory, said Petition seeking annexation to the Village of Elk Grove Village; and WHEREAS, said land and territory is not within the Corporate limits of any municipality but is contiguous to the Village of Elk Grove Village, and has no electors residing thereon; and WHEREAS, a public hearing has been held before the Plan Commission of the Village of Elk Grove Village, sitting as a Zoning Commission to consider the question of rezoning the subject property from B-1 Business District to the I-1 Restricted Industrial District and the granting of a special use permit in the I-1 Industrial District to permit the development of a Motor Inn and two (2) restaurants; and WHEREAS, any Fire Protection District, Library District, Township Road Commissioner, County Clerk or other entity or person entitled to notice prior to annexation of the subject Pr0P("-Ly has been given such notice as is required by law; arul WHEREAS, all statutory requirements in reference to the Annexation have been fully complied with and the Village President and Board of Trustees believe it to be in the best interest of the Village that said land and territory be annexed thereto; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook and DuPage, Counties Illinois as follows: Section 1: That the land and territory, legally described on Exhibit A, attached hereto and by this reference incorporated herein, which land and territory is contiguous to the Village of Elk Grove Village, and not within the limits of any other municipality, be and the same is hereby annexed to the Village of Elk Grove Village, so that said territory shall be included within the boundary limits of said Village as is by law in such case made and provided. Section 2: That all requisite fees due upon annexation to the Village of Elk Grove Village have been paid. Section 3: That said property shall be rezoned from B-1 Business District to the I-1 Restricted Industrial District, and said property shall be granted a special use permit in the I-1 Industrial District to permit the development of a Motor Inn and two (2) restaurants. Section 4: That the Village Clerk of the Village of Elk Grove Village is directed to record a certified copy of this Ordinance, together with a Plat of said territory, with the Recorder of Deeds of Cook County, Illinois. - 2 - Section 5: That this Annexation is in conjunction with and subject to the terms and conditions set forth in the Annexation Agreement by and between the Village and the Petitioners.
