HomeMy WebLinkAboutORDINANCE - 1650 - 6/12/1984 - INOPERATIVE MOTOR VEHICLESORDINANCE NO. 1650 AN ORDINANCE AMENDING CHAPTER 14 OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE BY ESTABLISHING PROVISIONS FOR INOPERATIVE MOTOR VEHICLES WHEREAS, Chapter 24, Sec. 11-40-3 of the Illinois Revised Statutes provides that any municipality in the State of Illinois may by Ordinance declare inoperable motor vehicles on public or private property to be designated a nuisance; and WHEREAS, the Village of Elk Grove Village acting pursuant to said Section and further acting pursuant to its powers and authorities as a home rule municipality as set forth and defined in the Constitution of the State of Illinois deem it to be in the best interest of the Village to establish such an Ordinance; NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Chapter 14 of the Municipal Code of the Village of Elk Grove Village, be and the same is hereby amended by adding thereto a new Article which Article shall read as follows: IX. Inoperable Motor Vehicles. 14.1101 Definition. Inoperable Motor Vehicle as used in this Article shall mean any motor vehicle from which, for a period of at least thirty days, the engine, wheels, or other parts have been removed, or on which the engine, wheels or other parts have been altered, damaged or otherwise so treated that the vehicle is incapable of being driven under its own motor power. 14.1102 Inoperable Motor Vehicle Prohibited. It shall be deemed a nuisance and, therefore, unlaw- ful for any person, firm or corporation to permit or cause an inoperable motor vehicle to be located on any public or private property within the Village after having received a notice from the Police Department as hereinafter set forth. 14.1103 Notice. When the Police Department is advised or otherwise becomes aware of the existence of an inoperable motor vehicle, said Department shall immediately notify and advise the owner of the vehicle or the owner of the property on which the vehicle is located to remove the vehicle or otherwise cause said vehicle to be in an operating condition within sixty days from the date the notice is issued. 14.1104 Penalty. Any person, firm or corporation violating any of the provisions of this Ordinance shall be subject to a fine of not less than Twenty- five ($25.00) Dollars nor more than Five Hundred ($500.00) Dollars for each offense and a separate offense shall be deemed committed on each day during or on which the violation occurs or continues to exist. Section 2: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
