Home My WebLink AboutORDINANCE - 1564 - 4/5/1983 - VEHICLE LICENSES, AMENDEDORDINANCE NO. 15A4 AN ORDINANCE AMENDING SECTIONS 14.325, MOTORCYCLES: 15.002, LICENSES; 15.003, FEES; 15.005, APPLICATION - ISSUANCE; 15.006, TIME OF PAY- MENT - LICENSE YEARS; 15.008, USE OF FUNDS; 15.009, PENALTY; AND 24A.101 -B, SETTLEMENT OF PENALTIES, OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, as follows: Section 1: That Section 14.325, Motorcycles, be and the same is hereby amended by adding thereto the following: Any vehicle having 50 cc. piston displacement or less is prohibited from operation on streets and public property in the Village. Section 2: That Section 15.002, Licenses, be and the same is hereby amended to read as follows: 15.002 Licenses. Every owner and operator of a motor vehicle, as defined herein, who: a. Resides within the Village, or b. Is registered to any residential, business or commercial property within the Corporate limits of the Village, or C. Is registered to another Municipality, County, State or Foreign Country, but is housed or sheltered for use on any public street within the Village shall pay each year to the Finance Department of the Village a tax or license fee as hereinafter provided, excepting therefrom residents, businesses and commercial interests that establish residency with the Village between March 1, and May 31, of any year, and having paid a similar fee to another Municipal entity, validated by the displaying of said license sticker on the windshield, or other designated location of the motor vehicle. Section 3: That Section 15.003 Fees be and the same is hereby amended to read as follows: Motor bicycle and scooter $ 9.00 (150 cc. piston displacement of less) Motorcycle (over 150 cc. piston displacement) $15.00 Passenger Cars $15.00 Dealer Plates $15.00 Recreational Vehicles $15.00 Trucks - having a gross weight of not more than 10,000 pounds, including the weight of the vehicle and maximum load $35.00 Trucks - having a gross weight of more than 10,000 pounds but not more than 20,000 pounds, including the weight of the vehicle and maximum load $55.00 Trucks - having a gross weight of more than 20,000 pounds but not more than 36,000 pounds, including the weight of the vehicle and maximum load $75.00 Trucks - having a gross weight of more than 36,000 pounds but not more than 50,000 pounds, including the weight of the vehicle and maximum load $95.00 Trucks - having a gross weight of more than 50,000 pounds, including the weight of the vehicle and maximum load $115.00 The horsepower and weight shall be determined in the manner prescribed by Statute for determining these factors for the purpose of fixing State license fees. Not withstanding the provisions of this Chapter, the vehicle license fee required of persons sixty-five years of age and over and for handicapped person shall be fifty cents ($0.50) per passenger automobile each year. Any individual requesting such reduced rate shall provide such evidence as is requested by the Finance Department evidencing ownership of the licensed vehicle, age and/or handicapped status. Section 4: That Section 15.005, Application - Issuance, be and the same is hereby amended by deleting the word "Clerk" and inserting the words "Finance Department" from that Section. Section 5: That Section 15.006, Time of Payment - License Years, be and the same is hereby amended to read as follows: 15.006 Time of Payment - License Years. Such license fee shall be due and payable annually in advance on the first day of June of each year and the license shall be for a one year period. Any person who purchases a vehicle or who becomes a resident of the Village during the last six (6) months during a licensing year or who submits a sworn affidavit, properly notarized, stating that the vehicle for which the license is being sought, was not in use for the first six (6) months of any licensing year and can substantiate said affidavit to the satisfaction of the Finance Department, may, upon making application be issued a license for the remainder of the License period upon payment of one-half (1/2) of the fee herein required. - 2 - Section 6: That Section 15.008, Use of Funds, be and the same is hereby amended by deleting Section 15.008 in it entirety. Section 7: That Section 15.009, Penalty, be and the same is hereby amended by renumbering to Section 15.008 and further amended to read as follows: 15.008 Penalty. Any person, firm or corporation violating the requirements of this Chapter shall be subject to a fine according to the following schedule. Section 8: That Section 24A.101 paragraph "B" be and the same is hereby amended by amending Section 15.007 of the Municipal Code Violated (Settlement Amount) to read as follows. - 3 - 24A. 101B In cases of violations relating to the failure to purchase a license, if same is purchased prior to payment of the settlement amount. Section 10: That the Village Clerk be and is hereby directed to publish this Ordinance in Pamplet Form. Section 11: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. - 4 - PASSED this 5th day of April 1983.
