HomeMy WebLinkAboutORDINANCE - 1579 - 6/14/1983 - HEIGHT VARIATION/BONAVENTUREORDINANCE NO. 1579 AN ORDINANCE AMENDING ORDINANCE NO. 1392 PERTAINING TO A HEIGHT VARIATION FOR PROPERTY LOCATED ON BONAVENTURE DRIVE, NORTH OF DEVON AVENUE, EAST OF ROHLWING ROAD IN ELK GROVE VILLAGE (SBL) WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village pursuant to Ordinance No. 1392 duly adopted and approved on the 12th day of August, 1980 granted a variation to permit the construction of a four (4) story building with a nine (9') foot equipment penthouse on Lots 2 and 3 in Rohlwing Grove Unit No. 4; and WHEREAS, the Owner of said Lots 2 and 3 has recently petitioned the Village for a variation and a Zoning Ordinance text amendment to permit the construction of a Nursery School on Lot 3 of said Subdivision; and WHEREAS, the development of said Nursery School on Lot 3 may have a material effect on the ability to provide adequate parking for the four (4) story building originally proposed for said property; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village find and believe it to be in the best interest of the Village to amend Ordinance No. 1392 accordingly; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Ordinance No. 1392 insofar as said Ordinance granted a variation for the construction of a four (4) story building on property legally described as Parcel 2 in said Ordinance, be and the same is hereby amended as follows: A) That the variation previously granted Lots 2 and 3 permitting a four (4) story building with a nine (9') foot equipment penthouse be and the same is hereby transferred to Lot 2 provided that the Owner of said property complied in all respects with the parking requirements as set forth in the Zoning Ordinance. B) Should the Owner not be able to provide sufficient parking for a four (4) story building on Lot 2, then the height variation herein granted shall be reduced to such height that would accommodate the appropriate and required amount of parking stalls required by the Zoning Ordinance. Section 2: That the variation granted with respect to Lots 8 and 9 as set forth in Parcel 1 of Ordinance No. 1392 remain in full force and effect. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 6 NAYS: 0 ABSENT: 0 APPROVED: Charles J.
