AN ORDINANCE ANNEXING AND REZONING
CERTAIN PROPERTY TO THE VILLAGE OF
ELK GROVE VILLAGE (WHERE ELSE LOUNGE,
INC.)
WHEREAS, a written Petition has been filed with the
Village Clerk of the Village of Elk Grove Village by The Roselle
State Bank as Trustee under Trust No. 1183, the Arvey Corporation,
and Margaret and Erwin Kirchhoff, the Owners of Record of
the hereinafter described land and territory, said Petition
being for Annexation to the Village of Elk Grove Village; and
WHEREAS, said land and territory is not within the
Corporate Limits of any municipality, but is contiguous to
the Village of Elk Grove Village, and has no electors residing
thereon; and
WHEREAS, all applicable provisions of the Illinois
Revised Statutes concerning Annexation have been complied
with; and
WHEREAS, this Annexation is pursuant to an Agreed Order
entered in Case No. 80 M1-70560, said Order being entered on
the 17th day of June, 1983; and
WHEREAS, the President and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage,
Illinois after having examined said Petition to Annex, find
and believe it to be in the best interest of the Village
that said land and territory be annexed to the Village of
Elk Grove Village and zoned as a 3-2 Business Use;
NOW, THEREFORE, BE IT ORDAINED, by the President and
Board of Trustees of the Village of Elk Grove Village, Counties
of Cook and DuPage, Illinois as follows:
Section 1: That the land and territory described in
Exhibit A attached hereto and incorporated herein, which
territory is contiguous to the Village of Elk Grove Village,
and is not within the limits of any municipality be and
the same is hereby annexed to the Village of Elk Grove Village.
Section 2: That said property shall, upon annexation,
be zoned 3-2, Business District in accordance with the Zoning
Ordinance of the Village of Elk Grove Village so that hereafter
said territory shall be included within the boundary lines
and limits of said Village of Elk Grove Village as is by law
in such cases made and provided.
Section 3: That said property is hereby annexed to the
Village pursuant to the Agreed Order of Case No. 80 M1-70560
entered into on the 17th day of June, 1983 and is binding upon
the Petitioner and the Village of Elk Grove Village, their
vendees, assigns and successors in interest.
Section 4: That the village Clerk of the Village of
Elk Grove Village is hereby directed to record a certified copy
of this Ordinance together with an accurate Plat of Annexation
of said territory with the Recorder of Deeds of Cook County,
Illinois, and is further directed to amend the Zoning Map of
the Village in accordance with the provisions hereof and to
file such Notice of Annexation as is required by law.
Section 5: That this Ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.

Range 11, East of the Third Principal Meridian, described by commenc-
ing at the Northwest corner of said Southeast Quarter and running
thence South along the West line of said Southeast Quarter, 970.20 feet
to the South line of the North 971.0 feet of said Southeast Quarter, as
monume.nted and occupied; thence North 89 degrees 21 minutes 46
seconds East along s. id South line, 249.63 feet to the East line of Lively
Boulevard for a place of beginning; thence continuing North 89 degrees
21 minutes 46 seconds East along said South line, 439.37 feet; thence
