HomeMy WebLinkAboutORDINANCE - 1513 - 3/23/1982 - PROHIBITED PARKING AMENDEDORDINANCE NO. 1513 AN ORDINANCE AMENDING SECTION 14.514 HANDICAPPED PARKING OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE WHEREAS, the Village of Elk Grove Village is a home rule municipality as defined in the Constitution of the State of Illinois and as such has the power and authority to enact certain regulations pertaining to its local governmental affairs; and WHEREAS, it has come to the attention of the President and Board of Trustees of the Village of Elk Grove Village that there exists inadequate parking facilities for the handicapped and disabled of the Village; and WHEREAS, based on the recommendation of the Judiciary Planning and Zoning Committee of the Village, it is deemed to be in the best interest of the Village that the handicapped parking provisions of the Municipal Code be amended so as to require the installation of adequate handicapped narking facilities within the Village; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Sec. 14.514 Handicapped Parking of the Municipal Code of the Village of Elk Grove Village, be and the same is hereby amended to read as follows: 14.514. Parking Facilities for the Handicapped/Prohibited Parking. A) All off-street parking areas in the Village which provide parking for commercial, professional or service related establishments licensed to do business or perform a service by the Village of Elk Grove Village or the State of Illinois must provide vehicular parking facilities according to such terms and conditions as are hereinafter set forth. The provisions of this Section shall not apply to those parking areas with ten (10) or less parking spaces. B) The number of parking spaces required for vehicles driven by or used by the handicapped or disabled shall be as follows: TOTAL NUMBER OF PARKING SPACES 11-400 401 and above NUMBER OF PARKING SPACES REQUIRED a minimum number of 1 or 2% of the total provided whichever is greater 8 plus 1% of the total provided above 400 C) Each handicapped parking space shall be a minimum of 15 feet wide and shall be marked to indicate that they are reserved for the handicapped or disabled using the International Symbol for accessibility. The location of the handicapped parking spaces and the manner in which the identification sign is affixed or posted must be approved by the Building Department of the Village of Elk Grove Village. All such signs shall be purchased, installed and maintained by the owners of the property where the signs are located. D) It shall be unlawful for any person to park, stand or otherwise allow a vehicle to be in a stopped position in any parking area of the Village which has been designed and posted as a handicapped parking area. The provisions of this Section shall not apply to any motor vehicle having an identification card on display in its windshield (which identification card declares the possessor thereof to be a handicapped person and which card has been issued by any of the Townships of the State of Illinois; or a motor vehicle bearing registration plates issued to a physically handicapped person pursuant to Sec. 3-616 or to a disabled veteran pursuant to Sec. 3-609 of the Illinois Vehicle Code). ection 2: Any person, firm or corporation who complies with the provisions of this Ordinance shall not be deemed to be in violation of other applicable parking ordinances with respect to the number of parking stalls required if such viola- tion is caused or directly related to the compliance with the conditions hereof. Section 3: Any person, firm or corporation violating the provisions of this Ordinance shall be subject to a fine of not less than Ten ($10.00) Dollars nor more than Two Hundred ($200.00) Dollars for each offense. - 2 - Section 4: That this Ordinance shall be in full force after its passage, approval, and publication according to law and be effective as of June 1, 1982.
