HomeMy WebLinkAboutORDINANCE - 1522 - 5/11/1982 - DAY CARE CENTERS, IN-HOMEORDINANCE NO. 1522 AN ORDINANCE AMENDING ARTICLE LIII, IN- HOME DAY CARE CENTERS OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE IN ORDER TO C014PLY WITH THE CHILD CARE PUBLIC ACT (PUBLIC ACT 82-441) WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village pursuant to Ordinance No. 1438 duly adopted and approved on the 17th day of February, 1981, established licensing provisions for In -Home Day Care Centers; and WHEREAS, said Ordinance adopted certain standards prescribed by the Illinois Department of Children and Family Services pursuant to the Child Care Act of 1969; and WHEREAS, the General Assembly of the State of Illinois recently amended said Child Care Act pursuant to Public Act 82-441 thus requiring an amendment to the Village Ordinance; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Article LIII of Chapter 18 of the Municipal Code of the Village of Elk Grove Village be and the same is hereby amended by deleting therefrom in the title and Sections 18.5302, 18.5304, 18.5305 and 18.5307 any reference to In -Home Day Care Centers and substitute in its place the words Day Care Homes. Section 2: That Section 18.5301 Definitions, be and the same is hereby amended to read as follows: 18.5301 - Definitions. "Day Care Homes" means family homes which receive more than three (3) up to a maximum of eight (8) children for less than twenty-four (24) hours per day. The maximum of eight (8) children includes the family's natural or adopted children and all other persons under the age of 14. The term does not include facilities which receive only children from a single household." Section 3: Any person, firm or corporation violating the provisions of this Ordinance shall be subject to a fine of not less than Twenty-five ($25.00) Dollars nor more than Five Hundred ($500.00) Dollars for each violation, and a separate violation shall be deemed committed on each day a violation occurs or continues to exist. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 5 NAYS: 1 ABSENT: 0 ATTEST: Fay M.
