AN ORDINANCE AMENDING ORDINANCE NO. 958 BY
AMENDING A SPECIAL USE PERMIT FOR A RESTAURANT
LOCATED IN THE INDUSTRIAL ZONED DISTRICT,
ELK GROVE VILLAGE. ILLINOIS
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove Village, pursuant to Ordinance No. 958 duly adopted
and approved on the 5th day of November, 1974 granted a special
use permit for the construction of a Yankee Doodle Restaurant
on property legally described therein, subject to the condition
that said restaurant be constructed within two (2) years from
the date of the adoption of the Ordinance, and further, subject
to the condition that the restaurant be named Yankee Doodle; and
WHEREAS, the restaurant was constructed within the
required two (2) year period and is in existence today; and
WHEREAS, certain conditions have existed so as to require
a cancellation of the lease between the legal owner of the
subject property and the Yankee Doodle Company; and
WHEREAS, the owner of the subject property has petitioned
the Village to remove the requirement that the restaurant be
named Yankee Doodle from the special use permit previously
granted, and the President and Board of Trustees after reviewing
the request of the Petitioner find and believe that the removal
of the condition with respect to Yankee Doodle does not sub-
stantially alter the intent and conditions of the special use
permit as originally granted:
NOW, THEREFORE, BE IT ORDAINED, by the President and
Board of Trustees of the Village of Elk Grove Village, Counties
of Cook and DuPage, Illinois as follows:
Section 1: That Ordinance No. 958, which Ordinance granted
a special use permit for a Yankee Doodle Restaurant in an
industrial district be and the same is hereby amended by deleting
therefrom any requirement that the restaurant have the name
Yankee Doodle attached thereto on premises legally described
as follows:
Reliance resubdivision of part of Lot 4 in
Higgins resubdivision (recorded April 11, 1966
as Document 19792047) in the SE , of Section 26,
Township 41 North, Range 11, East of the Third
Principal Meridian in Cook County, Illinois.
Section 2: That this Ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.
