HomeMy WebLinkAboutORDINANCE - 1532 - 8/10/1982 - GAS STATIONS/SELF-SERVICEORDINANCE NO. 1532 AN ORDINANCE AMENDING ARTICLE XLI, SERVICE STATIONS OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE TO REQUIRE THE RENDERING OF ASSISTANCE TO HA14DICAPPED MOTORISTS AT SELF-SERVICE DISPENSING PUMPS WHEREAS, the Village of Elk Grove Village is a home rule municipality as defined by the Constitution of the State of Illinois and does hereby adopt this Ordinance in its capacity as a home rule municipality; and WHEREAS, the Judiciary, Planning and Zoning Committee of the Village of Elk Grove Village, after having considered a request from the spokesperson representing various handicapped residents of the Village to require licensed service stations to assist handicapped motorists in the dispensing of motor fuel at a self-service pump, find and believe that such request has merit and is in the best interest of the Village; NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Article XLI, Service Stations, of Chapter 18, Licenses and Permits, of the Municipal Code of the Village of Elk Grove Village be and the same is hereby amended by adding thereto the following: 18.4106 Handicapped Motorist Assistance. All service stations licensed herein which provide both full service and self-service dispensing facilities shall render assistance to any handicapped motorist by dispensing motor fuel into their vehicle tanks at any self-service dispensing pump. For the purpose of this Section, a handicapped motorist shall mean an individual who possesses a handicap identification card issued by any of the Townships of the State of Illinois who is driving a motor vehicle alone or with another handicapped person or persons. Section 2: Any person, firm or corporation violating any of the provisions of this Ordinance shall be subject to a fine of not less than twenty-five ($25.00) dollars nor more than five hundred ($500.00) dollars for each offense, and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues. In addition to any penalties --1' provided herein, any licensee, or any agent or employee of a licensee who fails or refuses to comply with the provisions of this Ordinance shall be subject to the License Revocation proceedings set forth in Sec. 18.206 of the Municipal Code. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 6 NAYS: 0 ABSENT: 0 ATTEST: Patricia S.
