HomeMy WebLinkAboutORDINANCE - 1547 - 11/9/1982 - BUILDING ACTIVITY CODE/AMENDEDA ORDINANCE NO. 1547 An Ordinance Regulating Building Activities, Amending Chapter 13 of the Municipal Code of Elk -Grove Village Now, therefore, be it ordained by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and OuPage, SECTION ONE: Chapter 13 of the Municipal Code of Elk Grove Village is hereby repealed(ord. No. 1146). SECTION TWO: That Chapter 13 of the Municipal Code of Elk Grove Village is hereby amended by adding the following Articles and by incorporating the provisions, requirements, and procedures established within and by each Article: ARTICLE I DEPARTMENT OF DEVELOPMENT' & BUILDING ARTICLE II BUILDING CODE ARTICLE III FIRE PROTECTION SYSTEMS ARTICLE IV ELECTRICAL CODE ARTICLE V PLUMBING CODE ARTICLE VI MECHANICAL CODE ARTICLE VII PENALTIES ARTICLE I: DEVELOPMENT AND BUILDING DEPARTMENT 13.101 CREATION There is hereby created a Department of Development and Building which shall consist of a Building Commissioner and such other employees as may be authorized by the President and Board of Trustees. 13.102 BUILDING COMMISSIONER There is hereby established the position of Building The Building Commissioner shall have control and supervision over-all offices and employees assigned to the Department of Development and Building, subject to the general direction of the Village Manager. Wherever the term Building Official is used in any por- tion of the herein adopted codes, it shall mean the Building Commissioner of the Village of Elk Grove Village. F -2- Commissioner. The Building Commissioner shall be appointed by the Village Manager and shall serve at his discretion. The Building Commissioner shall have control and supervision over-all offices and employees assigned to the Department of Development and Building, subject to the general direction of the Village Manager. Wherever the term Building Official is used in any por- tion of the herein adopted codes, it shall mean the Building Commissioner of the Village of Elk Grove Village. F -2- ARTICLE I: DEVELOPMENT AND BUILDING DEPARTMENT 13.103 DUTIES Of THE BUILDING COMMISSIONER The Building Commissioner shall be responsible for: A. The enforcement of all ordinances and codes of the Village relating to the construction, repair, or alteration of the buildings and structures and the use of streets or parkways in connection therewith. B. All inspections to insure compliance with building construction regulations. C. The enforcement of all zoning and land use ordinances of the Village. D. The maintenance of current accurate land use and zoning maps of the Village. E. Performing such other duties as may be required by the Village Manager including providing assistance and advice as may be required by the Plan Commission, or other agencies of the Village. -3- i 13.104 BUILDING INSPECTOR CThere is hereby created the position of Building Inspector. The Building Inspector shall be appointed by the Village Manager and serve at his discretion. 13.105 DUTIES It shall be the duty of the.Building Inspector to inspect all buildings and structures being erected or altered, as frequently as may be necessary to insure compliance with the Village Ordianance. The Building Inspector shall be under the direction of the Building Commissioner. 13.106 EX -OFFICIO ELECTRICAL INSPECTOR The Building Commissioner shall also be the chief electrical inspector and ex -officio electrical inspector and shall have the power to inspect any electrical installations and no electrical wiring shall be covered until after such inspection. He shall also have the power to cause the current in any wiring or circuit or conduit to be turned off whenever this is necessary in an emergency to protect life or property. 13.107 EX -OFFICIO PLUMBING INSPECTOR The Building Commissioner shall also be the chief plumbing inspector and ex -officio plumbing inspector and - 4 - is hereby empowered to enforce all ordinances relating to the installation, care and standards of plumbing and shall make such inspections as may be necessary to insure compliance with such provisions. 13.106 COPIES OF PERMIT TO ASSESSORS In addition to all other duties, the Building Commissioner shall forward to the Township Assessors and County Assessors a copy of each building permit issued, at the end of each current month. I' 13,009 RECORDS - REPORTS The Building Commissioner shall keep records of all applications and shall show the disposal thereof. He shall make monthly reports to the Village Manager of his activities and of the services of the Department. He shall file such other reports as may be required by the Village Manager. - 5 - ARTICLE II: BUILDING CODE 13.201 ADOPTION OF REGULATIONS: ONE AND TWO FAMILY DWELLING UNITS The provisions of the One and Two Family Dwelling Code, 1979 Edition as prepared by the Nationally Recognized Model Codes, is hereby adopted as the regulations governing the construction of detached one and two family units, their appurtenances and accessory structures except as noted herein: a) The provisions of the BOCA Basic Code 1981 Edition shall apply to items not specifically covered by the One & Two Family Dwelling Code, C_ 1979 Edition. b) "Part VI ELECTRICAL" of said Code is hereby deleted and replaced by Article IV of this Chapter. c) Chapter 2, Building and Planning, One and Two Family Dwelling Code, 1979 Edition, is revised by adding to section R-216 SMOKE DETECTOR SYSTEMS, the following sentence at the end of the paragraph: The quantity, location and operation of these detectors shall meet the requirements of NFPA Std. #74 1978 Edition level #4 protection. - 6 - Three copies of said One and Two Family Dwelling Unit Code, 1979 Edition, are available for inspection and on file in the Office of the Village Clerk. 13.202 ALL OTHER STRUCTURES The 1981 Edition of the Basic Building Code as pre- pared by the Building Officials and Code Administrators International, Inc. is hereby adopted as the regulations governing the construction of all other buildings and structures in the Village of Elk Grove Village. Detached one and two family dwelling unit provisions of the 1981 B.O.C.A. Basic Building Code shall not prevail, when specifically covered in the One and Two Family Dwelling Code, 1979 Edition. The 1981 B.O.C.A. Basic Building Code is hereby modi- fied and amended in such manner as is set forth in the remaining Article of this Chapter. Three copies of said 1981 B.O.C.A. Basic Building Code are available for inspection and on file in the office of the Village Clerk. - 7 - art the following into their spect. . Board of Trustees M*w i 13.204 Section 106 Moved Structures shall be amended L by adding the following: A. No person, firm or corporation shall move any building on, through, or over any street, alley, sidewalk or other public place in the Village without having obtained a permit therefore from the Building Commissioner. Applications for such permits shall be made in writing to the Building Commissioner and shall state thereon the proposed route and number of days it is intended that the building shall occupy any portion of any public street. B. No permit shall be issued to move a building to a location within the Village of Elk Grove Village to a location when the use of said building at said location would cause a violation of applicable regulations. C. .Any person, firm, or corporation applying for a per- mit under this Article shall prior to receiving a permit, submit a bond with a lawful corporate surety to be approved by the Village attorney, con- ditioned on compliance with all the provisions of this Article and agreeing to pay and holding the C. (continued) public street by the building or structure moved. D. Whenever a public street is used, safety warning devices shall be provided by a permittee as required by the Police Department. E. Whenever it shall be necessary to interfere with wires or cables of public utility in moving a build- ing, the applicant for a permit shall furnish evidence that appropriate arrangements have been made with the affected public utility. C_ F. Whenever it shall be necessary in moving a building to traverse non -Village public streets, it shall be the responsibility of the applicant for a permit hereunder, to furnish evidence that appropriate permission has been secured from the agency or party who maintains and/or owns the non -Village public street to be used. G. Whenever a building or structure is moved or demolished, the sites shall be maintained in a safe condition and restored to grade in accordance with the provisions of Article 18 of the B.O.C.A. Basic Building Code, 1981 Edition. - 10 - Village harmless from any claim which may be made against it by reason of the occupation of any public street by the building or structure moved. D. Whenever a public street is used, safety warning devices shall be provided by a permittee as required by the Police Department. E. Whenever it shall be necessary to interfere with wires or cables of public utility in moving a build- ing, the applicant for a permit shall furnish evidence that appropriate arrangements have been made with the affected public utility. Basic Building Code, 1981 Edition. - 10 - 13.205 DELETE THE FOLLOWING SECTIONS IN THEIR ENTIRETY Section 109.1 thru 109.9 inclusive Section 110.1 thru 110.8 inclusive 13.206 REQUIRED PERMIT Section 111.1, When Permit is Required, is amended to read as follows: When Permit is Required: When the value of con- struction is three hundred dollars ($300.00) or more it shall be unlawful to construct, enlarge, alter or demolish a structure; or change the occupancy of a building or structure requiring greater strength, exitway or sanitary provisions; or to change to a prohibited use; or to install or alter any equip- ment for which provision is made or the installation of which is regulated by this code, without first filing an application with the building official in writing and obtaining the required permit therefore; except that ordinary repairs, as defined in Section 104.0, which do not involve any violation of this code shall be exempt from this provision. Fences and/or dense plantings shall not be installed without first securing a permit pursuant to the Zoning Ordinance of the Village of Elk Grove Village. `\ 13.207 PLANS AND SPECIFICATIONS Section 111.5, Plans and Specifications, is deleted and amended to read: 111.5 Plans and Specifications The application for a permit shall be accompanied by not less than four complete copies of plans and specifica- tions bearing the seal and signature of a registered architect, structural or professional engineer pursuant to the Statutes of the State of Illinois. Said plans and specifications shall be drawn to a scale to show with clarity the details and dimensions of the work to be performed and the material to be used. The Building Commissioner is authorized to modify and/or waive the requirement for plans and/or specifications when the proposed work is of a minor nature. Prelimfnary Plan Review services may be performed by the Building Commissioner or his authorized representative upon receipt of sufficient information of partially com- pleted plans for the purpose of providing advice and assistance about Village requirements and standards. Said service shall be performed for a fee not to be in excess of one-half of the established fee normally charged for full and final plan review and approval. Any fees paid for said preliminary review shall not be credited toward the cost for final plan review work. - 12 - 13.208 PLOT DIAGRAM Section 111.6, Site Plan, is amended as follows, and is to include the following as the beginning of the section: 111.6 Plot Plan and Survey In addition to the requirements below, evidence shall be furnished to the Building Commissioner, such as a plat of survey of said lot prepared by a licensed Illinois Land Surveyor, that the intended building site / is a lot of record. l . Except for an addition to a single family resi- dence, and their accessory structure, the Building Commissioner shall be provided with a plat of survey showing the location of said subsurface improvements in reference to property lines and other structures located on the same property under development and the elevation of subservice improvements per USGS datum, prior to proceeding with above -ground improvements, prepared by a licensed Illinois Land Surveyor. - 13 - 13.209 SUSPENSION OF PERMIT Section 112.2, Suspension of Permit, is hereby deleted and amended to read: 112.2 Suspension of Permit Any permit issued shall cease to be valid when approved work at the site has not started within sixty (60) days of the date issued, or been completed within twelve (12) months of the date issued, or been diligently pursued for a period of thirty (30) days following commencement of any work at the site unless otherwise extended by the Building Commissioner. 13.210 SECTION 114.0 FEES Shall be amended as follows: A fee for each plan examination, building permit and inspection shall be as established by the President and Board of Trustees. The fee for a permit to move a structure or building shall be as established by the President and Board of Trustees. The fee for a permit for the demolition of a buildi.ng or structure shall be as established by the President and Board of Trustees. - 14 - C 13.210 FEES (continued) The fee for a permit to erect signs and similar structures shall be as established by the President and Board of Trustees. Section 114.4, Accounting, is hereby deleted and amended to read: All accounting and fiscal responsibilities shall be performed as required by the State of Illinois Statutes and the Municipal Code of the Village of Elk Grove Village. ( Section 114.5, Refunds, is hereby deleted and amended \ to read: 114.5 Refunds: Refunds for fees paid shall not be authorized nor made. 13.211 UNLAWFUL CONTINUANCE Section 118.2 is hereby amended to read: 118.2 Unlawful Continuance It shall be unlawful for any person to continue any work in or about any building after having been served with a Stop Work order, except as may be authorized by the Building Commissioner to elimin- ate violations and/or unsafe conditions. - 15 - 13.212 COMPENSATION OF BOARD SURVEY Section 123.3 Compensation of Board Survey, is hereby deleted in its entirety and emended to read: 123.3 Compensation Compensation of any person serving on the Board of Survey shall be as determined by the President and Board of Trustees. 13.213 BOARD OF APPEALS Section 124.3 Compensation of Board of Appeals, is hereby deleted in its entirety and amended to read: 124.3 Compensation Compensation of any person serving on the Board of Appeals shall be determined by the President and Board of Trustees. 13.214 GENERAL DEFINITIONS Section 201 Add the following definition: Fire Official: The Fire Chief or other designated authority charged with the administration of the fire service of this jurisdiction. 13.215 FIRE LIMITS Delete Section 501.2 in its entirety and amend to read: The Fire Limits shall comprise all property now or hereafter zoned as office, business, or commercial perperty (8-1, B-2, B-3, B-4 0-T, and B-5 0-P). Any property rezoned or reclassified as office, business, - 16 - ur commercial property shall u_ within ane Fire Limits by virtue of Zoning or said reclassification. 13.216 TABLE OF THE 1981 B.O.C.A. BASIC BUILDING CODE a Amend the following Table of the 1981 B.O.C.A. Basic Building Code. Table 505, Line R-2 under Columns 4A and 4B shall be limi*.ed to ei^ht dwelling units or less, over eight (8) units not permitted. 13.217 PHYSICALLY HANDICAPPED & AGED Section 515, is hereby deleted in its entirety. 13.218 PARKING LOTS Section 622 Parking Lots, is hereby deleted in its entirety and add new Section 622. All parking and off-street loading areas shall be installed in accordance with the requirements of -the Elk Grove Village Zoning Ordinace. 624.4 - to read same as revised Section 622. 13.219 SWIMMING POOLS A. Section 627.4 is deleted in its entirety. For location, see Ordinance 842, Section 3.54D. B. Section 627.6.2 is hereby deleted and amended to read: 627.6.2 Drainage Systems Water demand from a pool shall not be discharged to the storm sewer during periods of rain or storms. At no time shall the rate of drain water exceed a flow of 200 gallons per minute. - 17- 13.219 YMING POOLS (continued) 627.9 Safety Devices Change depth of pool from 24" to 30". 13.220 HIGH RISE BUILDINGS Section 629.3 Options - The following sections are hereby deleted: 629.3 Options 629.3.2 Area of Refuge 629.3.2.1 Division of floor area 629.3.2.2. Stairway & Elevator 629.3.2.2 Exterior Openings 629.3.2.4 Wall Construction 629.3.2.5 Floor/ceiling Construction 13.221 AUTOMATIC FIRE SUPPRESSION SYSTEM Section 629.3.1 Automatic Fire Suppression System is revised to read as follows: 629.3.1 Automatic Fire Suppression System: An automatic fire suppression system shall be installed throughout the building. The system shall be designed using the parameters set forth in Article 17 and the requirements of Section 629.3.1.1 through 629.3.1.3. 13.222 TYPES AND LOCATION OF MEANS OF EGRESS Section 807.2.1 Exit discharge: Amend by adding the following: - 18 - 13.222 TYPES AND LOCATION OF MEANS OF EGRESS (continued) Doorway grading: From each grade floor exitway there i shall be provided, after exiting the structure, a hard surfaced area a minimum of forty-eight (48) inches in width centered at the thirty-two (32) inch minimum required opening and extending to a property line adjoining a public street or alley or a point which is a minimum of ten (10) feet clear from any part of the structure. At the exit door, the level of the exterior surface shall not be elevated from the floor inside the door, nor shall it be more than two (2) inches below the floor inside the door. A grade floor exitway shall not have a threshold greater than one-half (1/2) inch high, with beveled edges. The floor and exterior surface shall `A not have a grade of more than two (2) per cent for a distance of five (5) feet either side of the door. The remainder of the required exterior hard surfaced area shall have, in the direction of exiting, an elevating gradient not greater than five (5) per cent. Such walks shall be of a continuing common surface not interrupted by steps or abrupt changes in grade. Exception: One -and two-family dwellings (use group R-3). Section 812.2 Number of Doorways: Amend last sentance to read: All doors shall swing in the direction of egress travel. - 19 - 13.223 EXIT SIGNS AND LIGHTS Section 823.2 Delete "or in other approved distinguished colors". 13.224 MEANS OF EGRESS LIGHTING Section 824.4 Emergency Lighting System Section 824.4.2 through 824.4.6 are amended to read as follows: 824.4.2 Use Group B: In all buildings of Use Group 8 containing more than 100 occupants or when having one or more floors above or below grade. 824.4.3 Use Group F: In all buildings of Use Group F. 824.4.4. Use Group M;. In all buildings of Use Group M when greater than 3,000 square feet (2792) in area on any floor, or when having one or more floors above or below grade floor. 824.4.5 Use Group R-1: In all buildings of Use Group R-1 containing more than 25 sleeping rooms. 824.4.6 Use Group R-2: In all buildings of Use Group R-2 containing more than 50 occupants. 824.4.7 Use Group S. In all buildings of Use Group S. 824.4.8 Windowless buildings: In all windowless buildings or portions thereof except buiid:ngs of Use Group R-3. - 20 - 13.225 FIRE WALLS AND PARTY WAL Section 1407.5, 1407.5.1, 1907.5.2 and 1407.5.3 are hereby deleted in their entirety and amended to read: 1407.5 Continuity of walls: In all buildings and structures, wall shall be continuous from foundation to 2 feet 8 inches (07. ;.,:) above the roof surface. 13.226 PRECAUTIONS DURING BUILDING OPERATIONS Section 1801.1 Temporary Construction, is deleted in its entirely and amended to read: 1801. A. A Building Permit shall not be issued until an operational plan has been submitted to and approved by the Building Commissioner. The operational plan shall indicate emergency fire apparatus vehicle access, as determined by the Fire Chief , capable of supporting an emergency fire apparatus vehicle weighing 42;000 lbs., truck runways, employee parking areas, and material storage yards. B. A $1,500.00 Cash deposit or irrevocable letter of credit, payable to and on demand by the Village of Elk Grove Village shall be deposited with the Village Treasurer. C. The cash deposit or letter of credit shall be cashed and called to the extent necessary to meet expenses incurred by the Village of Elk Grove Village if any aspect of the operational plan is violated, or if the requirements of Section 13.227 are not observed. Construction work shall '1 - i 13.226 1901.1 Temporary Construction ',!ontin I) cease if the level of the cash deposit or letter of credit is not restored within four business days and said work shall not be resumed until said deposit requirements are met. 0. Upon successful completion of all construction activities authorized by a permit and final inspection approval by the Building Commissioner, the cash deposit or letter of credit then on file with the Village shall be returned unused to the depositor by the Village Treasurer. E. The Building Commissioner may, when the work to be performed under a permit is minor in nature or scope, authorize a cash deposit or letter of credit or other deposit of less than $1,500.00 to fulfill the above requirements. 13.227 MAINTENANCE Section 1804.1 Maintenance, is hereby amended to include the following as the last paragraph in the section: 1804.1 Maintenance A. It shall be unlawful to allow dirt, debris, gravel, stone concrete or any other material to be deposited, dropped or thrown on a street which has been prepared for construction, repair or reconstruction or which nas a bituminous paving course in place. The Building Commissioner and his authorized representatives are authorized to stop all construction activity if upon prior written notice by him to the owner's agent or general contractor, such materials are not removed within two (2) hours. - 22 - 13.227 MAINTENANCE (continued) B. Failure of the Builder and/or developer to maintain the emergency fire apparatus vehicle access routes in a usable fashion, as determined by the Fire Chief or to abide by the approved said operational plan shall constitute sufficient grounds for the Building Commissioner to suspend any building permit issued in the affected area (Ref. 13.225). C. The cash deposit or letter of credit, required under Section 13.225, shall be used or cashed to the extent of expenses incurred by the Village if any Village employee, Villaae equip- ment, or Village contracted services are used to remove any such material from any street as described above. Said expenses shall be deter- mined in accordance with a schedule of charges approved by the President and Board of Trustees and on file in the Office of the Village Clerk. 13.228 SIGNS AND OUTDOOR DISPLAY STRUCTURES Article 19, _Signs and Outdoor Display structures, is hereby deleted in its entirety and amended to read: Article 19 Signs and Displays It shall be unlawful to construct, erect, remove relocate, expand or alter any sign, display or similar item of any size or nature without first securing a permit pursuant to the Sign Regulations of the Village of Elk Grove Village. - 23 - ARTICLE III - FIRE PROTECTION SYSTEMS 13.301 SCOPE The Provisions of this article specify where fire protection and detection systems shall be required in all buildings or structures or parts thereof hereafter erected. The 1981 B.O.C.A. Basic Building Code, Article 17 as herein after amended and hereby adopted as the regulations governing the installation of fire protection and detection systems. NOTE: FIRE PROTECTION SYSTEMS ARE NO LONGER IN THE MECHANICAL CODE. 13.302 amended FIRE SUPPRESSION SYSTEMS Section 17.02.2 Delete Exception Add Section 1702.8.1: 1702.8.1 - Use Groups R -l: In all buildings or structures of use groups R-1: 1. When of more than two stories in height; r L 2. When more than 50 habitable rooms are located above the first floor. 1702.12 - Storage and workshop areas: Amended to read as follows: In all portions of Use Group A, B, I and R-2 occupied for storage, work- shop or similar purpose. Exceptions: 1. 2. (To be retained as is.) 13.303 WATER SPRINKLER SYSTEMS Section 1704. Add new sub -section 1704.9 Sprinkler water runoff: A minimum of one (1) four (4) inch floor drain or other approved means shall be provided for every 10,000 square feet of floor area on the grade or subgrade levels and for every 5,000 square feet on any floor area above the grade floor. The location of the drain shall be approved by the Fire Official prior to the issuance of any building permits. (Section 13.302 amended by Ord. No. 1638 passed 4-24-84.) - 24 - 13.304 LIMITED AREA SPRINKLER SYSTEMS Section 1705.5 Sprinkler Alarm: Section 1705.5 is amended to read as follows: Section 1705.5 Sprinkler Alarms - Alarm and alarm attachments shall be required when there are more than 10 sprinklers on the system. a 13.305 AUTOMATIC FIRE ALARM SYSTEMS Section 1716.2 Approval Amend the last sentence to read as follows: The automatic detecting devices shall be combination heat and photo electric smoke detectors. (continued on following page) - 25 - 13.306 AUTOMATIC FIRE ALARM SYSTEMS (oontinu-'l Heat detectors may be used in special areas, when approved by the Fire Chief. Section 1716.3.3 Use Group B or R-2 Sub Section 1716.3.3 is amended to read as follows: Use Group B or R-2 in all buildings of use R-2: 1. When of more than two (2) stories in height; or 2. When more than fifty (50) habitable rooms are located above the first or grade floor. Use Group B: 1. When of more than two (2) stories in height; or 2. When more than 7,500 square feet in area per floor. Exception: In buildings of Use Group R-2 smoke detectors are not required within the dwelling units except as required by Section 1716.3.4 Add the following sections: Section 1716.3.5: Senior Citizens Housing as defined in the Elk Grove Zoning Ordianance shall be provided with a complete heat and smoke detection system. Section 1716.3.6: In all buildings of use Group;; A-1, A-2 and A-3 with an occupancy load of more than 50 persons as computed in accordance with Article 8CO shall be equipped with an approved heat and smoke detection system. - 26 - 13,305 AUTOMATIC FIRE ALARM SYSTEMS (continued) Section 1716,.3.7: All recreational purpose buildings shall be equipped with an approved heat and smoke detection system. Section 1716.3.8: In all buildings of use Group A-4, when more than 1000 square feet in area shall be equipped with an approved heat and smoke detector system. Exception: Buildings equipped with a complete fire suppression system. Section 1716.4: Sprinkler Building Exception: Section 1716.4 is amended to read as follows: Sprinkler building exception: The requirements for { an automatic fire alarm system may be omitted in building or portions thereof equipped with an automatic fire suppression system when approved by the Fire Official. The manual fire alarm system conforming to Section 1717.0 shall be required. This exception does not apply to single station smoke detectors as required in Section 1716.3.4. .13.306 MANUAL FIRE ALARM SYSTEMS Section 1717.3 where required is hereby amended to include the following: In building of Use Group S-1, S-2, and I occupancies more than 2 stories in height or more, than 150,000 square feet in floor area of the same tenant area, a manual fire alarm system is required. - 27 - 13.307 SUPERVISION Section 1718.2 Fire Protection Systems Section 1718.2 is amended to read as follows: Section 1718.2 Fire Protection Systems: All fire protection systems shall have a direct connection to the the Elk Grove Village Fire Department Communications Center or an alternate method of connection as approved - by the Fire Chief. 13.308 FEES The fees for fire protection plan review shall be as established by the President and Board of Trustees. -28- ARTICLE IV ELECTRICAL CODE 13.401 PERIODIC PERMITS A Periodic Permit for the installation, alteration and repair of electrical conductors and equipment may be issued to a person only where such electrical work is to be performed in or on the premises or property owned or controlled by the said person, and used exclusively by him to conduct his business. 13.402 It shall be unlawful to obtain a Periodic Permit under the terms. of this article fcr the installation, alteration, and repair of elctrical conductors or apparatus where such r work is performed under or by contract. 13.403 No Periodic Permit shall be issued to any person until a qualified electrician is appointed as required by this Code. 13.404 Where an applicant has complied with this Code, the Chief Electrical Inspector or his authorized representative shall certify him as a qualified electrician to said person, firm, or corporation. 29 _ 0 13,405 QUALIFIED ELECTRICIAN Before any permit to install, alter, or repair electrical work shall be issued to any person, entitled to secure permits under the electrical regulations of this Code, he shall appoint or employ a person who may himself or some other person w o, for the purpose of the electrical regulations of this Code, shall be known as a Qualified Electrician. The person so appointed or employed to act as a Qualified Electrician shall, before starting as such Qualified Electrician, be required to comply with this Code. 13.406 CERTIFICA71ON OF QUALIFIED ELcCTRICT.+."! To act as Qualified Electrician, the applicant shall be not less than twenty-one (21) years of age, and shall have at least four (4) years of experience in the.installation, alteration, repair, and maintenance of electrical wires, equipment, and apparatus, or in experience equivalent thereto. Names and addresses of employers, time employed, and in what capacity, and proof of such service shall be furnished to the Chief Electrical Inspector. The applicant may be required to answer correctly, a reasonable number of questions in writing to show that he has suffcient knowledge and technical training to perform said electrical work. - 30 - a 13.407 Whenever a Qualified Electrician shall leave or be discharged from the employ of any person or firm required to employ a Qualified.Electrician, within fourteen (14) days written notice shall be given the Building Commissioner by the employer. Permit privileges of such person or firm shall be suspended until a Certified Qualified Electrician is employed or appointed. 13.408 An annual, semi-annual or quarterly permit, (Periodic t_ Permit) for the installation, alteration, and repair of electrical wires and apparatus may be issued, and renewal permits issued at the expiration date of original permit, to persons where, due to their method of operation or the nature of their business, it is necessary to make frequent alterations and change of their electrical equipment. 13.409 Before any annual, semi-annual or quarterly permit (Periodic Permit) shall be issued to any person, he shall appoint or employ a Qualified Electrician in conformity with this code. - 31 - 13.410 PERMIT AND INSPECTION FEES All permit and inspection fees under this Article shall be established by the President and Board of Trustees. 13.411 ADOPTION OF CODE The National Electrical Code, 1981 Edition, is hereby adopted by the Village of Elk Grove Village as its official Electrical Code and shall continue to be and its provisions shall continue to be controlling in the electrical wiring and electrical construction of all buildings and structures within the corporate limits of the Village, excepc as the provisions contained in this Article may be in con- flict therewith, in which event the provisions contained in this Article shall prevail and said provisions of the National Electrical Code in conflict therewith shall be of no force and effect. 13.412 CONSTRUCTION REGULATIONS FOR SINGLE AND MULTI -FAMILY R-1, R-2, R-3 R-4, A-1, A-2 and A-3 RESIDENTIAL WIRING A. All detached structures requiring sl _trical shall be served underground in a approved manner, and shall be suitably protected against phy:ical darns-. B. All applications for permits to install or alter elec- trical wiring systems other than minor alteration or process wiring shall include plans indicating the following information: - 32 - 13.412 (continued) Outlets to same circuit, number of outlets on each circuit, number of outlets proposed, number and size of wire to be drawn in conduit and complete service and all feeder riser diagrams and grounding methods and material to be used. C. All installations or alterations of electrical equip- ment shall be inspected before any of the work is concealed. Any person, firm, company, or corporation shall notify the Chief Electrical Inspector or his duly authorized deputy, giving twenty-four (24) hours notics before the required electrical inspection. 1. The Chief Electrical Inspector or his au. authorized deputy is herein empowered to remove or cause to be removed from said building any material which might interfere with a thorough inspection. Said removal shall be at owner's expense. 2. After wires are drawn in the conduits and properly spliced, it shall be the duty of the person, firm, company, or corporation to notify the Chief Elec- trical Inspector or his duly authorized deputy who shall inspect such work within twenty=four (24) hours of such notice being given. - 33 - 13.412 (continued) 3. It shall be unlawful to use or turn on power into, or induce any electric current to flow through any wires or equipment hereafter installed until approved by the Chief Electrical Inspector. Commonwealth Edison Company shall not be permitted to i;:;zall a service meter unless approved by the Chief Electrical Inspector. 4. The foregoing does not restrict the issuance of the temporary approval by the Chief Electrical Inspector or his duly authorized deputy for the <� of electricity for construction purposes. 0. Exit and Emergency lighting systems shall be installed where required by the Elk Grove Village Building Code 1981 Edition BOCA Basic Building Code. 13.413 CONSTRUCTION REGULATIONS FOR COMMERCIAL AND INDUSTRIAL (I-1, I-2, B-1, B-2, B-3, B-4, B-5, 0-T and 0-P) A. Definition: Commercial and Industrial Building shall by definition include all buildings or structures in the above districts. B. Provisions for Commercial and Industrial wiring: 1. Service equipment may have multiple disconnects, but they shall be in one common enclosure. (a) Drawings shall be submitted to the Electrical Inspection Department of the Village of Elk Grove Village for approval - 34 - 1� l 13.413 (continued) before any custom built electrical equipment rated 1,000 amperes or larger is installed for use in service or distribution wiring system. (b) The switchboard manufacturer who builds or assembles the service equipment shall submit three sets of detail drawings of his proposal,• incuding the current interrupting capacity of all overcurrent devices, to the Utility Inspection Department (or the individual working for the Utility and designated by them as their plan examiner) who upon approval will retain one copy, stamp with their approval the two remaining copies of the drawings and forward them to the Department of Electrical Inspection of Elk Grove Village, who in turn will, upon approval, attach the Village approval stamp and return one copy to the Submitter bearing the approval stamp of both the Village and the Utility and any changes, corrections, additions, or deletions necessary for approval. C. Pendant hung flexible cable and cord will be permitted with the written approval of the Chief Electrical Inspector or his duly authorized deputy under those circumstances where the use of flexible cord as a wiring method is necessary to the method of operation - 35 - 0 13.413 (continued) due to frequent alterations and changes of the electrical equipment. All such cables shall contain a GROUND conductor and shall be terminated in approved fittings. 13.414 ALL INSTALLAIICNS OR ALTERATIONS OF ELECTR:CAL SHALL BE INSPECTED BEFORE ANY OF THE WORK IS CONCEALED Any person, firm, company, or corporation shall notify the Chief Electrical.Inspector or his duly authorized deputy giving him twenty-four (24) hours notice before the required electrical inspection. A. The Chief Electrical Inspector or his duly authorized deputy is therein empowered to remove or cause to be removed from said building any material which might interfere with a thorough inspection. Commonwealth Edison Company shall not be permitted to install a service meter unless approved by the Chief Electrical Inspector. E. (b) The use of water is permitted in all compressor type refrigeration units having standard rated capacities o one an -1 -..ns r,r (c) a-- (c) .All cbmpressor type r?frigeration units having standard rated capacities of one and one-half 0 1/2) tons or over shall be equipped with evaporative coolers and condensers, water cooling towers, spray ponds or other water cc._'.in equipment so that all water from the mains is used for make- up purposes only. - 41 - 13.604 (continued) *Note in (b) and (c) capacities shall be in accordance with conditions given in Standard A.S.R.E. Testing and Rating Codes. (d) If other than compressor types of refrigeration units are used, the consumption of water from the mains shall be limited in amount to not more per ton of refr- igeration producted than would be used by the compressor type described under (c) above when such trype is operated under normal condictions. 13.605 Add the following: M 609.1.1 The replacement of an existing appliance, in one and two family dwelling units, with appliance of an equiva- lent capacity shall not require alterations or changes to the structure or to the venting systems. 13.606 AIR POLLUTION CONTROL Article II - Air Pollution Control is hereby deleted in its entirely. There is hereby adopted by the Village of Elk Grove Village for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion the BOCA (Building Officials b Code Administrators International Inc.) It shall be the duty of the Officer in Charge of the Fire Prevention Bureau to: A. Enforce all laws and ordinances of the State, County and Village, covering the following: 1. The prevention of fires; 2. The storage and use of explosives and flammables; 3. The maintenance of automatic and other fire alarm systems, and fire extinguishing equipment: 4. Provide technical staff assistance and support to the Buildinc Commissioner of the Village of Elk Grove Village in the follow- ing areas: 1. Examination of plans for new construction, reconstruction or alteration of structures and to advise the Building Commissioner thereon of the extent of non-compliance with established Village requirements and codes relating to life, safety and fire prevention, alerting and suppression systems. - 2 - 2. Inspection of construction in progress to advise the Building Commissioner thereon of non-compliance with life, safety, and fire prevention, alerting and suppresion systems previously approved for said construction. 3. Review of existing and new standards, codes and requirements to advise the Building Commissioner thereon of changes considered necessary for improved life, safety, and fire prevention, alerting and suppression systems. C. A report of the Fire Prevention Bureau shall be made annually to the Fire Chief and transmitted to the Village Manager of the Village of Elk Grove Village. The report shall contain all proceedings under this Code, with such data as the Chief of the Fire Department may require, including recommendations to improve the Fire Prevention Code. 6.307 Definitions.) A. Whenever the word "Municipality" is used in 'the Fire Prevention Code, it shall be held to mean the Village of Elk Grove Village. B. Whenever the term "Corporation Counsel" is used in the Fire Prevention Code, it shall mean the Village Attorney for the Village of Elk Grove Village. C. Whenever the term "Village Manager" is used in this Fire Prevention Code, it shall mean the Village Manager of Elk Grove Village. D. Whenever the term "Fire Official" or "Chief of the Fire Prevention Bureau" is used in this Fire Prevention Code, it shall mean the Fire Chief of the Fire Department of the Village of Elk Grove Village. E. Whenever the term "Building Commissioner" is used in the Fire Prevention Code, it shall mean the Building Commissioner of the Village of Elk Grove Village. - 3 - 6.308 Prohibition of Storage and Location of Certain Matter.) 1 A. Storage of flammable liquids in outside above ground i tanks referred to in section F-2903.0 paragraph F- 2903.1 of the BOCA Basic Fire Prevention Code 1981 Edition is hereby prohibited. B. New bulk plants for flammable liquids referred to in section F-2902.0 of the BOCA Basic Fire Prevention Code 1981 Edition is hereby prohibited. C. Bulk storage of liquified petroleum gas referred to in section F-3100.0 of the BOCA Basic Fire Prevention Code 1981 Edition is hereby prohibited unless: 1. Said storage is in accordance with all require- ments of the 1979 Edition of Pamphlet 58 of the National Fire Protection Assocaiton. 2. A security fence six feet (6') in height with barbed wire above is constructed and provided around all such tank installations, said fence shall be so constructed as to screen from view the lower six feet (6') of the tank installation. s 3. The plans for said bulk storage and construction are approved by the Fire Chief as being safe from fire hazards and in accordance with the provisions hereof. 4. That no tanks be installed in the flood plain, except when provided with devices capable of anchoring the tank to prevent its going afloat under flood conditions. 5. That no transfiliing operations will be allowed except that which is required from the mobile tank, truck or railroad car to the stationary above ground storage tank and private filling stations utilizing Liquefied Petroleum Gas in company owned or leased vehicles. a. That it be mandatory that the person doing the transfiliing operations be trained by the installing or servicing company on the safety aspect and fire prevention procedures associated with Liquefied Petroleum Gas transfilling operations as approved by the Fire Department. - 4 - 6.309 Amendment of the Fire Prevention Code.) The BOCA Basic Fire Prevention Code as herein adopted is hereby deleted and/or amended as follows: A. Those sections of the Fire Prevention Code making reference to permits being required are hereby deleted. 6.310 Modifications.) The Fire Prevention Bureau may modify any provision of the Fire Prevention Code upon application in writing thirty (30) days from the date of an order by the Bureau submitted by the owner or lessee, or his duly authorized agent, when there are practical difficulties in carrying out the strict letter of the Code, provided that the spirit of the Code shall be observed and public safety secured. The particulars of such modification when granted or allowed and the decision of the Fire Prevention Bureau shall be entered upon the records of the department and a signed copy shall be furnished the applicant and to the Village Manager. 6.311 Appeals.) Sections 104.1 and 104.2 of the 1981 BOCA Fire Prevention Code are hereby deleted and amended to read: A. Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant a license or permit applied for, or when it is claimed that -the provisions of the code have been misconstrued or wrongly interpreted, the applicant may, upon payment to the Village Treasurer a sum equal to the estimated cost for publication and court reporter services, appeal from the decision of the Chief of the Fire Department to the President and Board of Trustees within thirty (30) days from the date of the decision on the modification application. B. The said President and Board of Trustees shall designate a time and place for a public hearing thereon and the applicant and Fire Chief may present pertinent information. The decision of the President and'Trustees shall be final. A refund of the money not used for the foregoing shall be made to the applicant by the Village Treasurer. -5- 6.312 New Materials or Processes Which May Require Permits.) The Chief of the Fire Department, the Officer in Charge of the Fire Prevention Bureau and the Building Commissioner shall act as a Committee to determine and specify, after giving affected persons an opportunity to be heard, whether certain specifications and materials not presently enumerated in the Code, may be allowed in addition to those now enumerated in said Code. The Chief of the Fire Department shall post such list in a conspicuous place in the Fire Department Headquarters Station, Office of the Building Department, Office of the Village Clerk, and make copies thereof available to other interested persons. 6.3_3 ccess to Structure.) When access to or within a structure or an area is unduly difficult because of secured openings or where immediate access is necessary for lifesaving or firefighting purposes, the Chief may require a key box to be installed in an accessible location. The key box shall be a type approved by the Chief and shall contain keys to gain necessary access as required by the Chief. 6.314 Penalty.) Any person, firm or corporation violating any of the provisions of this Article shall be subject to a fine of not less than Ten ($10.00) Dollars nor more than Five Hundred ($500.00) Dollars for each offense, and a separate offense shall be deemed committed on each day during or on which a violation or failure to comply occurs or continues. PUBLISHED this 17th day of November, 1982, in Pamphlet Form in the Elk Grove Daily Herald. - 6 - RESOLUTION No. 20-77 FEE SCHEDULES A RESOLUTION ESTABLISHING FEES FOR PLAN REVIEW AND FOR BUILDING PERMITS NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1: PLAN REVIEW Preliminary Plan Review services shall be performed for a fee not to be in excess of one half of the established fee normally charged for Pull and final plan review and approval. Any fees paid for said preliminary review shall not be credited toward the cost for final plan review work. A Plan Review for each set of plans for single family residence - . . . . . $30.00 A Plan Review for each set of plans for single family residence for alteration, remodeling or detached structure - . . . . . $10.00 The applicant for a building permit for any other type of construction shall pay the following fees when making application for the purpose of deferring 'village expense in examining and reviewing plans and specifications: NOTE: For the purpose of clarifying the following schedule - BASIC BUILDING CODE - is referred to as BBC BASIC PLUMBING CODE - is referred to as BPC BASIC MECHANICAL CODE - is referred to as BMC 1 The fee for a Plan Review is based on the volume of the building (see Section 119.0 of the Basic Building Code) as follows: Volume Building Code (cubic ft.) Base Plan Review Fee* Up to 20,000 $ 65. 20,001 - 40,000 85. 40,001 - 60,000 115. 60,001 - 80,000 140. 80,001 - 100,000 165. 100,001 - 150,000 195. 150,001 - 200,000 230. over 200,000 $230 plus 12.30 per each 10,000 ft. over 200,000 ft.3 *Building code review fees for Assembly and Institutional Uses and Mercantile Covered Malls (over 40,000 ft.3) shall be 1.5 times the indicated base fee. Multiple Building Code Review Fee by 1.5 when Mechanical and Plumbing Code Review is required. A Preliminary Plan Review fee shall be 0.50 times the building code review fee. 2 The MINIMUM fee for reviewing plans for minor interior alterations and re- modeling for other than single family residences shall not be less than . . . $10.00 Any additional and exceptional expenses incurred by the Village for Plan Review NOT covered by the above fees shall be paid by the applicant. Section 2: BUILDING PERMIT FEES Industrial and Commercial - $5.00 for ea. $1,000 of construction value Single family residence - $5.00 for ea. $1,000 of construction value Single family alteration or remodeling or detached structure. Moving of building amended Sign Fees: $5.00 for ea. $1,000 of construction value $200.00 per ea. day or fraction thereof. Permit fees - Every applicant before being granted an original permit hereunder shall pay to the Village the following permit fee for.each sign structure: 1. Non -illuminated signs - $15.00 plus $.15 per square foot of sign surface area of the proposed sign 2. Illuminated signs - $25.00 plus $.15 per square foot of sign surface area of the proposed sign. 3. Temporary Signs - Permit fee - $10.00 Monthly Inspection Fee - $5.00 4. Annual Inspection Fee. The annual inspection fee for all signs which will require same shall be one-half the then required permit fee for said sign. Swimming Pools: 1. Pools capable of containing 1,500 gallons or fraction thereof - $10.00. 2. Each additional 1,500 gallons or fraction thereof - $1.50. (Sign Fees amended and Swimming Pools added by Res. No. 51-77 passed 7-12-77.) 3 Electrical Fees: A. Plumbing Fees The fees for plumbing permit shall be five dollars ($5.00) for each plumbing fixture including plumbing system, bathtub, lavatories, closets, sinks, laundry tubs, drinking fountains, shower receptacles, urinals, soda fountains, and traps shall be considered fixtures. Fire Suppression Systems $25.00 for first 100 heads 5.00 for every 100 additional heads or fraction thereof B. Standpipes $10.00 for first standpipe 5.00 for every additional standpipe C. Fire Pumps - $30.00 for any size pump D. Fire Alarm System (manual or automatic) $30.00 for any size system E. Partial Fire Protection Equipment Installation $25.00 for each system 7 Elevator Ins, -tions The fees for the inspection of mechanical and electrical safety devices for passenger and freight elevators, man - lifts, moving stairs and dumbwaiters shall be $30.00 per inspection. The required number of inspections shall be as indicated in the B.O.C.A. Basic Building Code 1975 Edition, Section 1602. Re -Inspection Fee. Wherever in this Article inspections are required and due to incorrect or inaccurate information given by the owner or agent of the premises, a re -inspection or additional inspection is required, an additional fee of $10.00 per, inspection shall be charged. Section 3• That the Village President and Village Clerk are hereby authorized to sign said fee schedule for and in the name of the Village and attach thereto the corporate seal. f Section 4• That this resolution shall be in full force and effect from and after its passage and approval according to law. H RESOLUTION NO. 1-73 A RESOLUTION ESTABLISHING A FEE SCHEDULE FOR CLEANING DIRTY STREETS WHEREAS,*Ordinance No. 1547, The Building Activities Code, Chapter III, Section 330, establishes a requirement relating to damage to public facilities and dirt on streets by contractors constructing buildings withi"n the Village, and WHEREAS, the attached fee schedule sets the fees for the express purpose of guaranteeing that the builder will be responsible for any damage to public facilities and cleaning of streets. NOW, THEREFORE, BE IT RESOLVED by The President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and OuPage, State of Illinois, that the attached fee schedule for clean - Ing dirty streets will be in full force and effect from and after its passage and approval according to law.'
