HomeMy WebLinkAboutORDINANCE - 1479 - 9/8/1981 - RZONING NW CORNER NERGE & ROHLWINGORDINANCE NO. 1479 AN ORDINANCE REZONING THE NORTHWEST CORNER OF ROHLWING AND NERGE ROADS, ELK GROVE VILLAGE FROH R-3 RESIDENTIAL TO B-2 BUSINESS WHEREAS, the Plan Commission of the Village of Elk Grove Village, acting as a Zoning Commission, at a public meeting duly called and held according to law considered the question of rezoning property located at the Northwest corner of Rohlwing and Nerge Roads, Elk Grove Village from R-3 Residential to B-2 Business; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village after having considered the recommendation of said Plan Commission find and believe it to ba in the best interest of the Village that said property be so rezoned subject to certain conditions recommended by the Plan Commission; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the property located at the Northeast corner of Rohlwing and Nerge Roads, Elk Grove Village,and legally described as follows: That part of the Southeast Quarter of Section 36, Township 41 North, Range 10, East of the Third Principal Meridian, described as: Commencing at the Northeast corner of the Southeast Quarter of said Section 36; thence South 00 02' 32" West along the East line thereof for a distance of 1068.98 feet to the point of intersection of said East line and a line 217.00 feet (measured at right angles) Northeasterly of and parallel with the Northeast line of Nerge Road as dedicated per Document Number 12985717; thence North 630 09' 44" West along said parallel line 202.00 feet; thence South 260 50' 16" West 217.00 feet to the Northeast line of Nerge Road aforesaid; thence South 630 09' 44" East along said Northeasterly line for a distance of 311.59 feet to the East line of the Southeast Quarter of Section 36 aforesaid; thence North 00 02' 32" East along the East line thereof 243.11 feet to the place of beginning (excepting therefrom that part lying East of the West line of Rohlwing Road per Document Number 11069335), in Cook County, Illinois. be and the same is hereby rezoned from R-3 Residential to B-2 Business and that said property hereafter be subject to all of the conditions and regulations of the B-2 Business District, subject to the following conditions: A. That the property be developed in accordance with the site plan previously filed with the Plan Commission setting forth the construction of a one (1) story building for business, professional and retail use. B. That any commercial use on the subject property be restricted so as not to permit a twenty-four (24) hour continual operation or a coin operated amusement center. C. That the off-street loading space required by the Zoning Ordinance be located adjacent to the proposed building. D. That all provisions for ingress and egress to and from the subject property be approved by the Chief of Police and the Chief of the Fire Department. Section 2: That the Village Clerk is hereby directed to amend the official map of the Village to reflect the zoning change set forth herein. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law, and the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form.
