HomeMy WebLinkAboutORDINANCE - 1483 - 9/29/1981 - ANNEXATION/TRI COMMUNITY BAPTIST CHURCHORDINANCE NO. 1483 AN ORDINANCE ANNEXING AND REZONING CERTAIN PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE (NORTH AMERICAN BAPTISTS, INC. AND TRI -COMMUNITY BAPTIST CHURCH WHEREAS a written petition has been filed with the Village Clerk of Elk Grove Village by North American Baptists, Inc., and Tri -Community Baptist Church, the owners of record of the hereinafter described land and territory, said petition being for annexation to the Village of Elk Grove Village; and WHEREAS, said land and territory is not within the corporate limits of any municipality but is contiguous to the Village of Elk Grove Village, and has no electors residing thereon; and WHEREAS, all applicable provisions of the Illinois Revised Statutes concerning annexation have been complied with; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, after having examined said petition to annex, and having held a public hearing duly called and held according to law, considering the petition for annexation and the Pre -Annexation Agreement, find and believe it to be in the best interest of the Village that said land and territory be annexed to the Village of Elk Grove Village and zoned as an R-3 Residential Use, including the special uses incorporated therein; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the land and territory described in Exhibit A attached hereto and incorporated herein, which territory is contiguous to the Village of Elk Grove Village, and is not within the limits of any municipality, be and the same is hereby annexed to the Village of Elk Grove Village. 0 Section 2: That said property shall, upon annexation, be zoned R-3 Residential in accordance with the Zoning Ordinance of the Village of Elk Grove Village so that hereafter said territory shall be included within the boundary lines and limits of said Village of Elk Grove Village, as is by law in such cases made and provided. Section 3: That said property is hereby annexed to the Village pursuant to a Pre -Annexation Agreement dated September 29 , 1981, duly adopted and approved by the Village of Elk Grove Village by Resolution No. 56-81 passed and approved on the 29th day of September 1 1981, and that said Annexation Agreement is binding upon the Petitioner and the Village of Elk Grove Village and all vendees, assigns, and successors in interest. Section 4: That a Special Use Permit is hereby granted to the North American Baptists, Inc., and Tri -Community Baptist Church in order that the land and territory annexed herein be utilzed as a Church facility in accordance with the Zoning Ordinance of the Village of Elk Grove Village. Section 5: That the Village Clerk of the Village of Elk Grove Village is hereby directed to record a certified copy of this Ordinance together with an accurate plat of annexation of said territory with the Recorder of Deeds of Cook County, Illinois, and is further directed to amend the Zoning Map of the Village in accordance with the provisions hereof and to file such notice of annexation as is required by law. Section 6: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. - 2 - VOTES: AYES: 7 NAYS: 0 ABSENT: 0 APPROVED: Charles S.
