HomeMy WebLinkAboutORDINANCE - 1495 - 11/24/1981 - ZONING ORDINANCE AMENDEDORDINANCE NO. 1495 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF ELK GROVE VILLAGE TO PROVIDE FOR A COMBINED MULTI -FAMILY RECREATIONAL DISTRICT (A-3) WHEREAS, the Zoning Ordinance of the Village of Elk Grove Village, as presently constituted, permits multiple family dwelling units in the R-4 (Planned Development), A-1 and A-2 Zoned Districts and subject to the conditions and requirements herein contained; and WHEREAS, there is no provision, at present, in the Zoning Ordinance which would permit the planning of multi- family structures and at the same time provide for the conveyance of the required open space for immediate public use absent a preliminary site plan depicting location, size, heighth and description of such structures; and WHEREAS, the Plan Commission of the Village of Elk Grove Village at public meetings duly called and held accord- ing to law considered the question of amending the Zoning Ordinance so as to establish a new A-3 Zoned District whilih would provide for a means of immediate conveyance of open space for development for public use within a framework of Zoning Controls pertaining to density, heighth of buildings, building setbacks, and the like, absent a specific time frame for the development of the multi -family structures to be located thereon; and WHEREAS, the new A-3 Zoned District would permit flexability of land use, encourage cooperation between private developers and government for the immediate benefit of the public, and enable government to properly control orderly land use and development; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village after having considered the recommendation and findings of said Plan Commission hereby approve and adopt same and find and believe it to be in the best interest of the Village that the Zoning Ordinance be amended to provide for a combined Multi -Family Recreational District (A-3); NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Article 5. Zoning Districts of the Zoning Ordinance of the Village of Elk Grove Village be and the same is hereby amended by adding thereto Sec. 5.37 et seq. entitled Combined Multi -Family Recreational District (A-3), a copy of same amendment being attached hereto and incorporated herein. Section 2: That the Zoning Ordinance is further amended as followd A. Sections 5.2, 5.22, 5.23, and 5.24 be amended by adding A-3 in each of said Sections. B. That the schedule of bulk and yard requirements and regulations contained in the Zoning Ordinance be amended by adding thereto the following: A-3 under the word District and the following under the remaining columns of said schedule: "as detailed in Sec. 5.37 et seq." C. That the definition of heighth as contained in Sec. 9.12 of the Zoning Ordinance be amended to read as follows: Heighth: The vertical distance from the highest finished grade at the building foundation to the top of the highest roof beams of a flat roof, or the mean elevation of the highest gable or slope of a hip roof. D. That Sec. 2-2.1 Use Districts of Article 2. of the Zoning Ordinance is hereby amended by adding therein the following: A-3 Combined Multi -Family Recreational District. - 2 - Section 3: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
