HomeMy WebLinkAboutORDINANCE - 1496 - 11/24/1981 - REZONING MULTI-FAMILY SEC. 24ORDINANCE No. 1496 AN ORDINANCE REZONING CERTAIN PROPERTY FROM R-3, RESIDENTIAL, TO A-3, COMBINED MULTI -FAMILY RECREATIONAL DISTRICT (CENTEX HOMES MIDWEST) WHEREAS, Centex Homes Midwest, Inc., has filed a Petition with the Village Clerk of Elk Grove Village, said Petition being for the purpose of rezoning certain property legally described hereinafter from R-3 Residential to A-3 Combined Multi -Family and Residential; and WHEREAS, the Plan Commission of the Village of Elk Grove Village, sitting as a Zoning Commission at public meetings duly called and held according to law considered the question of reclassifying said real estate to the A-3 Zoned District; and WHEREAS, said property is located at the extreme North- west corner of Elk Grove Village's Corporate Boundaries and is bordered on the South by the Chicago District Pipeline, on the West by Plum Grove Road, on the North by the Spring Valley Nature Sanctuary, and on the East by Meacham Road; and WHEREAS, to the Southeast of the subject property there exists property zoned and partially developed as a special use to the A-2 Multi -Family Zoned District of the Village, which use is consistent with that proposed for the subject property; and WHEREAS, the subject property, if rezoned t3 the A-3 District.will not have a deleterious affect on sorrounding property; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village after having considered the find- ings and recommendation of said Zoning Commission, find and believe that the highest and best use of said real estate is that of A-3 Combined Multi -Family and Recreational District: NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois as follows: Section 1: That the Zoning Ordinance of the Village be amended by reclassifying the property legally described on Exhibit A, attached hereto, from R-3 Residential to A-3 Combined Multi -Family and Recreational District. Section 2: That said real estate as reclassified shall be subject to all limitations and conditions placed upon properties in the A-3 Combined Multi -Family and Recreational District, as defined in the Ordinance aforementioned. Section 3: That this Ordinance is conditioned upon the adherence by the owner to all the provisions of the A-3 Zoned District and specifically to the provision requiring the conveyance of certain property legally described on Exhibit B, which property is in excess of the Fifty-five (558) percent open space requirement to a Municipal entity. Should said conveyance not be effectuated within ninety (90) days from the effective date of the passage of this Ordinance, the subject property legally described on Exhibit A shall revert back to its original R-3 Zoned District. Section 4: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 5: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
