AN ORDINANCE GRANTING AN AMENDED SPECIAL
USE PERMIT TO CENTEX HOMES MIDWEST, INC.
FOR THE DEVELOPMENT OF WINSTON GROVE
SECTION 24
WHEREAS, the Plan Commission of the Village of Elk
Grove Village, acting as a Zoning Commission, has conducted
public hearings duly called and held according to law to
consider the question of amending the Special Use Permit
for a Plan Unit Development previously granted by the President
and Board of Trustees to Centex Homes Midwest, Inc., pursuant
to Ordinance No. 1292 and as later amended by Ordinance
No. 1458; and
WHEREAS, the President and Board of Trustees of the
Village of Elk Grove Village, after considering the recommenda-
tion of said Plan Commission, find and believe it to be
in the best interest of the Village that said Special
Use Permit be further amended according to the recommendations
of said Plan Commission;
NOW, THEREFORE, BE IT ORDAINED, by the President
and Board of Trustees of the Village of Elk Grove Village,
Counties of Cook and DuPage, Illinois as follows:
Section 1: That Ordinance No. 1292 duly passed and
approved on the 10th day of April, 1979, and as amended by
Ordinance No. 1458 duly passed and approved on the 2th day
of May, 1981; be further amended in part as follows:
A. That Item 3. of Section 2 of Ordinance No. 1292
which Item requires the creation of an easement, be and the
same is hereby deleted in its entirety.
B. That Item 7. of Section 2 of Ordinance No. 1292 be
and the same is hereby deleted in its entirety and replaced
by the following:
The owner shall provide fifty (50%) percent common
open space which open space shall be owned and
maintained by an association established by the
owner, or a portion thereof may be owned by a
municipal corporation. The private common open
space owned by such association shall be graded
and seeded and shall be of a usable quality to be
used by the residents of the proposed development.
The grading and seeding shall be in conformity
with the standards of the Elk Grove Park District
provided therefor and shall be reviewed and approved
by the Village Engineer. The private common open
space owned by such association shall meet the
Village Engineer's requirements -for being in a
usable condition.
C. That Item 10. of Section 2 of Ordinance No. 1292
be and the same is hereby deleted and in its place insert
the following:
With the private common open space, the owner
shall provide an area or areas of no less than
60,000 square feet to be used by the residents
of the development for recreational activities.
The above parcel will be fine graded and seeded
for organized recreational activities shall be
consistent with the standards of the Elk Grove
Park District provided therefor.
D. That the Special Use Permit be further amended by
providing that of the 48.21 acres required to be dedicated
in compliance with the fifty (50%) percent open space require-
ment, that approximately 42.2 acres of same be transferred
from private ownership to Municipal ownership.
Section 2: That all other provisions of Ordinance
Nos. 1292 and 1458 not inconsistent with the provisions hereof
or specifically repealed by the provisions hereof shall
remain in full force and effect.
Section 3: That this Ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law, and the Village Clerk is hereby authorized
to publish this Ordinance in pamphlet form.
