AN ORDINANCE ANNEXING AND REZONING
CERTAIN PROPERTY TO THE VILLAGE OF
ELK GROVE VILLAGE (SEMAR)
WHEREAS, a written Petition has been filed with the
Village Clerk by Trinity Evangelical Divinity School and
Trinity College as Co -Trustees of the Martha Duvall Zender
Charitable Remainder Annuity Trust; First National Bank of
Mount Prospect, not individually but as Trustee under its
Trust Agreement No. LT -1524 dated January 28, 1980, W. J.
Taylor and Hazel Taylor, Phillip R. Semar, Larry McKone
(individually and doing business as McKone Builders), Herman
J. Semar and Semar Home Builders, Inc., an Illinois corporation,
being the owners of record and contract purchasers of the
hereinafter described land and territory, said Petition being
for annexation to the Village of Elk Grove Village; and
WHEREAS, said land and territory is not within the
corporate limits of any municipality, but is contiguous to
the Village of Elk Grove Village, and has no electors
residing thereon; and
WHEREAS, all applicable provisions of the Illinois Revised
Statutes concerning annexation have been fully complied with
including notice to any Fire Protection District, Library
District, Township Road Commissioner or any other entity
entitled to receive same; and
WHEREAS, the Plan Commission of the Village of Elk
Grove Village, acting as a Zoning Commission, has held Pre-
annexation Hearings, duly called and held according to
law, and as a result thereof, find and believe it to be in
the best interest of the Village that such property be annexed
to the Village and be granted such zoning as is hereafter
set forth; and
WHEREAS, the President and Board of Trustees of the
Village of Elk Grove Village after having considered the
findings of the Planning Commission, and having held a public
hearing duly called and held according to law with respect
to the Annexation Agreement pertaining to said annexation,
find and believe it to be in the best interest of the Village
that said land and territory be annexed to the Village of
Elk Grove Village;
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Elk Grove Village,
Counties of Cook and DuPage, Illinois, as follows:
Section 1: That the land and territory described in
Exhibit "A" of an Annexation Agreement dated the 14th
day of October
1980, by and between the Village of
Elk Grove Village and the Petitioner herein, copy of said
Annexation Agreement being attached hereto and incorporated
herein, which territory is contiguous to the Village of
Elk Grove Village and is not within the limits of any municipality,
be and the same is hereby annexed to the Village of Elk Grove
Village.
Section 2: That said property is hereby granted O -T,
Office Transitional Zoning,so that hereafter said territory
shall be included within the boundary lines and limits of said
Elk Grove Village under O -T Zoning, as is by law in such
cases made and provided.
Section 3: That said property is hereby annexed to the
Village pursuant to the attached Annexation Agreement dated
October 14, 1980, and that said Annexation
Agreement is binding upon the Petitioners and the Village of
Elk Grove Village, their grantees, assignees and successors
in interest.

Section 4: That the Village Clerk of the Village of
Elk Grove Village is hereby directed to record a certified
copy of this Ordinance together with an accurate plat of
annexation of said territory with the Recorder of Deeds of
Cook County, Illinois and is further directed to amend the
Zoning Map of the Village in accordance with the provisions
hereof. The Village Clerk is further authorized to give such
notice of the annexation provided for herein to the County
Clerk of Cook County, Illinois and such other parties as is
provided by law.
Section 5: That the Village Clerk is hereby directed
to publish this Ordinance in pamphlet form.
Section 6: That this Ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.
