AN ORDINANCE AMENDING ORDINANCE NOS. 1359, 1371, 1389,AND 1406
BY EXTENDING THE MORATORIUM DATE ON CONDOMINIUM CONVERSION
WHEREAS, the President and Board of Trustees of the Village of Elk
Grove Village pursuant to Ordinance Nos. 1359, 1371, 1389, and 1406 declared
a moratorium on Condominium Conversion pending the consideration of the
adoption of an Ordinance regulating same; and
WHEREAS, said Ordinance 1359 established that the moratorium be in full
force and effect up to and including May 27, 1980, and Ordinance Nos. 1371,
1389, and 1406 extended the dates for said moratorium up to and including
November 23, 1980; and
WHEREAS, a proposed Ordinance regulating Condominium Coversion is still
being considered by the President and Board of Trustees who find and believe
it to be in the best interest of the Village to extend the moratorium period
for an additional sixty (60) days;
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois,
as follows:
Section 1: That pursuant to its home rule powers, the Village of Elk
Grove Village hereby amends Ordinance Nos. 1359, 1371, 1389, and 1406 by
extending the moratorium period therein established for an additional sixty
(60) days following the effective date of this Ordinance. Said moratorium
shall be deemed null and void upon the passage, approval and publication of
the Condominium Conversion Ordinance within said sixty (60) day period.
Section 2: Any person, firm or corporation violating any of the
provisions of this Ordinance shall be fined not more than Five Hundred
($500.00) Dollars for each offense. No building permit, certificate of
occupancy, or license of any nature shall be issued by the Village in
connection with such conversion.
Section 3: A copy of this Ordinance shall be filed with the Recorder
of Deeds of Cook and DuPage Counties. The Village Clerk is hereby directed
to notify the Recorder of Deeds of the passage of this Ordinance and request
that no documents for the conversion of residential property to condominium
ownership be accepted for record.
Section 4: That this Ordinance shall be in full force and effect from
and after its passage, approval and publication according to law.
