HomeMy WebLinkAboutORDINANCE - 1423 - 11/25/1980 - AGRMT/COOK CTY HIGHWAY PERMITORDINANCE NO. 1423 AN ORDINANCE AUTHORIZING AN AGREEMENT BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND THE COUNTY OF COOK, IDEMNIFYING THE COUNTY OF COOK FOR ALL PERMIT WORK PERFORMED BY VILLAGE PERSONNEL IN THE COUNTY RIGHTS-OF-WAY NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1. That the Village of Elk Grove Village shall indemnify, keep and save harmless the County, its agents, officials and employees, against all injuries, deaths, loss, damages, patent claims, suits, claims, judgements, costs and expenses, liabilities, which may in anywise accrue against the County in consequence of the granting of this contract or which may in anywise result therefrom, whether or not it shall be alleged or determined that the act was caused through negligence or omission of the Village of Elk Grove Village, or its employees, of the subcontractor or its employees, if any, or of the County of Cook or its employees, and the Village of Elk Grove Village shall, at its own expense, appear, defend and pay all charges of attorneys and all costs and other expenses arising therefrom or incurred in connection therewith, and, if any judgement shall be rendered against the County in any such action, the Village of Elk Grove Village shall, at its own expense, satisfy and discharge the same. The Village of Elk Grove Village expressly understands and agrees that any per- formance bond or insurance protection required by this contract, or otherwise provided by Village of Elk Grove Village shall in no way limit the responsibility to indemnify, keep and save harmless and defend the County as herein provided. Section 2. The ordinance shall stipulate that the ordinance shall not be cancelled or changed without thirty (30) days written notice by registered mail to Mr. Richard H. Golterman, Cook County Superintendent of Highways, 118 North Clark Street, Chicago, Illinois 60602. Section 3. A copy of this agreement shall be delivered to Mr. Gabriel Ditore, Permit Division at the time this ordinance is passed. Section 4. Grantor agrees that if grantor terminates ordinance it will be cause for immediate termination and cancellation of all pending or unexpired permits. Section 5. That this ordinance shall be in full force and effect from and after its passage and approval according to law.
