AN ORDINANCE AMENDING ARTICLE XXXIII, LIVERIES OF
CHAPTER 18 OF THE MUNICIPAL CODE OF THE VILLAGE
OF ELK GROVE VILLAGE AS IT PERTAINS TO RULES AND
REGULATIONS
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Elk Grove Village,
Counties of Cook and DuPage, Illinois as follows:
Section 1: That Section 18.3305, Inspections, be and
the same is hereby amended by renumbering same to Section
18.3312 of the Municipal Code.
Section 2: That Section 18.3304, Regulations, of the
Municipal Code be and the same is hereby amended to read as
follows:
Section 18.3304 Issue and Placing of Tags/Stickers.
The Village Clerk shall issue in numerical order
suitable stickers or tags for each Livery vehicle.
Such tag or sticker shall be attached to the front
right windshield on each Livery while it is in use.
Section 3: That Article XXXIII, Liveries of Chapter 18,
of the Municipal Code be further amended by adding thereto
the following•
Section 18.3305 Transferring Tags/Stickers.
Tags or stickers may be transferred to any
Livery put into service to replace one withdrawn
from service.
Section 18.3306 Notify Clerk with State License Number.
The licensee shall notify the Clerk of the motor
number and state license number of each Livery operated
and of the corresponding municipal tag or sticker
number.
Section 18.3307 Duties of Driver.
It shall be the duty of every driver of a Livery to:
1. Obey all traffic rules established by State
Statute or Village Ordinance.
2. Accept as passenger any person who seeks to so
use the Livery provided such person is not
intoxicated and conducts himself in an orderly
manner, and has previously contacted the Livery
operator in accordance with the terms of this
Article.
3. Take his passenger to his destination by
the most direct available route from the
place where the passenger enters the Livery.

Section 13.3309 Condition of Livery.

Section 14.3310 State Driver's License.
No person shall drive a Livery, or be hired or
vermitted to do so, unless he is duly: licensed
by the Secretary of Stata of Illinois to operate
a -ehiclo trransporting 'are paying passengers.
Section 18.3311 Insurance.
No s:ch license shall be i =,ued to any person,
firm or corporation unless -_he applicant has
secured and submitted to t'.. Village Cl,rk, a
copy or copies of his or their insurance policies,
or Certificates of Insurance, with public liability
insurance coverage available for personal injuries
in an amount not 'less than $300,000.00 for each
person and $500,000.00 for each accident and
cc"erage for property damage in an amount not
less than 250,000.00 for each accident. In the
event that such policv or Certificate of Insurance
at any t.me iacomns ineffective by reason of
ncsice served uoo- the village or otherwise, or
in the event that the operator of a Livery has
failed to deposit such currently valid certificate
or policy of insurance, the license herein provided
for the operation of a Livery shall likewise
terminate forthwith and without further notice.
Section 18.3313 Suspension of License.
If any Livery shall become unsafe for operation
or if its body or seating facility shall be so
damaged, deteriorated or unclean as to render
said vehicle unfit for public use, the license
therefor shall be suspended by the Public vehicle
Commission or its authorized agent until the vehicle
shall be made safe for operation and its body shall
be repaired and painted and its seating facility
shall be reconditioned or replaced as directed by
the Public Vehicle Commission or its agent. In
determining whether any Livery is unFit for public
use the Comr.ission shall give consideration to its
effect on the health, comfort and convenience of
passengers and its public appearance on the streets
of the Villaqe. Upon suspension of a license for
any cause, under the provisions of this Article,
the License issued for said vehicle shall be immediately
returned to the Office of the Village Clerk until
such time as the Public Vehicle Commission or its
designated agent authorizes its re -issuance after
an inspection has been made and the vehicle is
again safe fc opera _ion in the Village.
Section 13.3111 Oper,tor's Permit.
No p'rson shall drive a Livery vehicle unless he shall
have secured a permit herefor as herein provided.
Section 18.3315 Application for Permit.
Any person desiring to secure an operator's permit
or renewal thereof shall make application in wr:tinu
therefor to the Village Clerk. Such application
shall set forth the name of the applicant, his
residence and occupation. Every applicant shall be
twenty-one (21) years of ace or over. Upon such
application, the Chief of Police shall make or
came. cc _ made, a careful and Bili rcn� inquiry as
to the character and record of the applicant for
honesty, sobriety, ane capability, and vision, and

if it shall be found that such applicant is
lacking in any of such respects, such permit shall
be refused. if the Chief of Police shall be
satisfied that the applicant is a fit _- n
be licensed, such application shall be approved
and a permit issued. Such permit shall have
affixed thereon a picture of the permittee and
shall contain such other descriptive matter of the
permittee as may be described by the Chief of
Police. A duplicate of the picture and the
applicant's finger prints shall be kept on file
in the Police Department. Such permit shall be
displayed at all times in the Livery in plain
view of the passenger.
Section 18.3316 Fee for Permit.
The fee for the initial issuance of an operator's permit
shall be Five ($5.00) Dollars and such permit shall expire
on the 31st day of May of each year following the
date of issue. The annual fee for any renewal
thereof shall be Three ($3.00) Dollars.
Section 18.3317 Revocation.
The Public Vehicle Commission may revoke any license
or operator's permit for repeated violation of
traffic laws, ordinances .)_v t,.e Hage, laws
regulating the conduct of the driver and failure
to render good service. Said revocation shall be
after a hearing and the licensee or operator shall
be granted an opportunity to defend charges made
against him.
Section 18.3318 Penalty.
Any person, firm or corporation who violates any
provisions of this Article shall be fined not less
than Twenty-five ($25.00) Dollars nor more than
Five Hundred ($500.00) Dollars for each and every
offense, and a separate offense shall be deemed
committed on each day during or on which a violation
occurs or continues.
Section 18.3319 Saving Clause.
The invalidity of any Section or part of any
Section of this Ordinance shall not effect the
validity of any other Section or part thereof.
Section 4: Any person, firm or corporation violating
any of the provisions of this Ordinance shall be subject to a
fine of not less than Twenty-five ($25.00) Dollars nor more
than Five Hundred ($500.00) Dollars for each offense, and a
separate offense shall be deemed committed on each day during
which a violation occurs or continues.
Section 5: The Village Clerk is hereby authorized to
publish this Ordinance in pamphlet form.
Section 6: This Ordinance shall be in full force and
effect from and after its passage, approval and publication
according to law.
