AN ORDINANCE GRANTING A SIDE -YARD VARIATION
OF THE ZONING ORDINANCE TO THE EXTON METAL
PRODUCTS, INC. TO PERMIT THE CONSTRUCTION OF
AN ENCLOSED INTER -CONNECTING PASSAGEWAY
BETWEEN TWO SEPARATE BUILDINGS LOCATED AT
144 AND 160 LIVELY BOULEVARD, ELK GROVE VILLAGE
WHEREAS, the Zoning Board of Appeals of the Village of
Elk Grove Village at a public meeting duly called and held
according to law considered the question of granting a variation
of the side -yard requirements of the Zoning Ordinance of the
Village to permit the construction of an enclosed inter-connectinq
passageway between two separate buildings on adjacent lots; and
WHEREAS, Exton Metal Products, Inc., is the owner of
record of both of said lots and it is the intention and recommenda-
tion of the Zoning Board of Appeals that such a variation
should only be granted so lona as said lots are owned by one
owner of record; and
WHEREAS, the Village of Elk Grove Village is a home rule
municipality as set forth and defined by the Constitution of
the State of Illinois and as such has the authority to place such
conditions, covenants and restrictions in the granting of
variations as the President and Board of Trustees deem necessary
in the best interest of the Village;
NOW, THEREFOREā BE IT ORDAINED, by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois, as follows:
Section 1: That there is hereby granted a variation of the
side -yard requirements of the Zoning Ordinance of the Village
of Elk Grove Village to Exton Metal Products, Inc., to permit
the construction of an enclosed inter -connecting passageway of
property located at 144 and 160 Lively Boulevard, Elk Grove
Village, and legally described as follows:
Lot 12 in Garlisch Subdivision Unit 11, being a subdivision
of part of the West 1/2 of the East 1/2 of Section 22, Township
41 North, Range 11, East of the Third Principal Meridian, in
Cook County, Illinois; and
Lot 13 in Garlisch Subdivision Unit No. 12, being a sub=
division of part of the West 1/2 of the East 1/2 of Section
22, Township 41 North, Range 11, East of the Third Principal
Meridian in Cook County, Illinois.
Subject to the following{ conditions and covenants:
a. That this variation shall remain in full force and
effect as long as the above real estate remains under
one owner of record.
b. If said property is ever conveyed in such a manner
so that the owner of one of the lots is not the
same as the owner of record of the adjacent lot,
then the variation herein shall terminate and the
enclosed inter -connecting passageway must be removed.
Section 2: Any person, firm or corporation violating any
of the provisions of this Ordinance shall be subject to a fine
of not less than Ten ($10.00) Dollars nor more than Five Hundred
($500.00) Dollars for each offense and a separate offense will
be deemed committed for each day on which a violation occurs
or continues to exist.
Section 3: That the Village Clerk is hereby authorized to
record a copy of this Ordinance with the Recorder of Deeds of
Cook County, Illinois.
Section 4: That this Ordinance shall be in full force and
effect from and after its passage, approval and publication
according to law.
