HomeMy WebLinkAboutORDINANCE - 1441 - 3/24/1981 - ANNEX 412 ACRES OAKTON STORDINANCE NO. 1441 AN ORDINANCE ANNEXING AND REZONING CERTAIN PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE (STEIN/OEHLERKING) `WHEREAS, a written Petition has been filed with the Village Clerk of Elk Grove Village by Minnie Stein, Harry Oehlerking and Katherine Oehlerking, being the owners of record of the hereinafter described land and territory, said Petition being for annexation to the Village of Elk Grove Village; and WHEREAS, said land and territory is not within the corporate limits of any municipality but is contiguous to the Village of Elk Grove Village, and has no electors residing thereon; and WHEREAS, all applicable provisions of the Illinois Revised Statutes concerning annexation have been fully complied with; and WHEREAS, the Plan Commission of the Village of Elk Grove Village has held Pre -Annexation Hearings duly called and held according to law and as a result thereof, find and believe it to be in the best interest of the Village that such property be annexed to the Village of Elk Grove Village and be rezoned to the A-2 residential district; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, after having examined said Petition to Annex, and having examined the findings of the Plan Commission, and having held a public hearing duly called and held according to law, con- sidering the Petition for Annexation and the Pre -Annexation Agreement, find and believe it to be in the best interests of the Village that said land and territory be annexed to the Village of Elk Grove Village and rezoned to the A-2 residential district. NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, as follows: Section 1: That the land and territory described in Exhibit A attached hereto and incorporated herein, which terri- tory is contiguous to the Village of Elk Grove Village, and is not within the limits of any municipality, be and the same is hereby annexed to the Village of Elk Grove Village. Section 2: That said property shall, upon annexation, be zoned A-2 residential, so that hereafter said territory shall be included within the boundary lines and limits of said Village of Elk Grove Village, as is by law in such cases made and provided. Section 3: That said property is hereby annexed to the Village pursuant to a Pre -Annexation Agreement dated March 24, 1981, duly adopted and approved by the Village of Elk Grove Village by Resolution No. 19-81 , passed and approved on the 24th day of March, 1981, and that said Annexation Agreement is binding upon the Petitioners and the Village of Elk Grove Village, and all vendees, assigns, and successors in interest. Section 4: That the Village Clerk of the Village of Elk Grove Village is hereby directed to record a certified copy of this Ordinance together with an accurate plat of annexa- tion of said territory with the Recorder of Deeds of Cook County, Illinois and is further directed to amend the Zoning Map of the Village in accordance with the provisions hereof and to file such notice of annexation as is required by law. Section 5: That this Ordinance shall be in full force and effect from and after April 8, 1981, after being duly passed, approved and published according to law. PUBLISHED this 1st day of April , 1981, in the Elk Grove Daily Herald EXHIBIT "A" THAT PART OF THE EAST 141.20 FEET OF THE WEST 241.20 FEET OF THE EAST HALF OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 27, TOWNSHIP 41 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, LYING NORTH OF A LINE 613.98 FEET SOUTH OF THE NORTH LINE OF SAID SECTION 27, ALSO THE EAST 141.20 FEET (EXCEPT THE SOUTH 720.0 FEET THEREOF) OF THE WEST 382.40 FEET OF THE EAST HALF OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 27 AFORESAID, AND ALL THAT PART OF OAKTON STREET LYING NORTH OF AND ADJOINING THE ABOVE DESCRIBED PROPERTY, IN COOK COUNTY, ILLINOIS.
