HomeMy WebLinkAboutRESOLUTION - 17-23 - 4/11/2023 - PURCHASE MIDWAY COURT PARCEL #0ZZ1152 FROM STATE OF ILLINOISRESOLUTION NO. 17-23 A RESOLUTION AUTHORIZING THE VILLAGE OF ELK GROVE VILLAGE TO PURCHASE MIDWAY COURT PARCEL #OZZ1152 FROM THE STATE OF ILLINOIS DEPARTMENT OF TRANSPORTATION FOR THE FAIR MARKET APPRAISED VALUE NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Village of Elk Grove Village, a home rule municipal corporation, is desirous to acquire title to Parcel OZZ1152 from the Illinois Department of Transportation in order to further the development of a high-tech data center campus. Section 2: That Parcel OZZ1152 is legally described as follows: Parcel OZZ1152 That part of Midway Court (formerly known as Higgins Road), in the Southeast Quarter of the Southeast Quarter of Section 22, Township 41 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois, bearings and distances based on the Illinois State Plane Coordinate System, East Zone, NAD 83 (2011 Adjustment), with a combined scale factor of 0.99995364, described as follows: Beginning at the northwesterly corner of Lot 3 in Regent Office Center Phase II Subdivision, according to the plat thereof recorded May 3, 1989 as Document No. 89199229, said point being on the east line of the West 210.00 feet of the Southeast Quarter of the Southeast Quarter of said Section 22; thence North 00 degrees 42 minutes 01 second West, on said east line, 88.20 feet to the southwest corner of Lot 1 in 1500 Midway Subdivision, being a subdivision in the east half of the Southeast Quarter of said Section 22, according to the plat thereof recorded September 24, 2020 as Document No. 2026817031; thence South 79 degrees 52 minutes 00 seconds East, on the south line of said Lot 1, a distance of 282.81 feet to the southeasterly corner of said Lot 1; thence South 00 degrees 42 minutes 01 second East, on the east line of said 1500 Midway Subdivision, 33.60 feet to the southeasterly corner of said 1500 Midway Subdivision; thence North 79 degrees 52 minutes 00 seconds West, on the south line of said 1500 Midway Subdivision, 171.08 feet to the east line of the lands acquired by IDOT per Condemnation Case No. 68 L 12783; thence South 00 degrees 42 minutes 01 second East, on said east line, 33.60 feet to the north line of said Lot 3 in Regent Office Center Phase II; thence South 89 degrees 17 minutes 59 seconds West, on said north line, 109.74 feet to the Point of Beginning. Said parcel containing 0.325 acre, more or less. October 31, 2022 Section 3: That the Illinois Department of Transportation, under 605 ILCS 5/4-508(c)(2) has offered the Village the opportunity to purchase Parcel OZZ1152 at the fair market appraised value, as established by an independent State Certified General Appraiser. Section 4: That the Village is hereby authorized to purchase Parcel #OZZI 151 for the fair market value of $283,500.00. Section 5: That this Resolution shall be in full force and effect from and after its passage and approval according to law.
