AN ORDINANCE AMENDING ORDINANCE NOS. 1138, 1354 AND
1400 BY PROVIDING FOR AN AMENDED SITE PLAN FOR THE
CONSTRUCTION OF A RESTAURANT AT THE NORTHWEST CORNER
OF LANDMEIER ROAD AND LIVELY BOULEVARD, ELK GROVE VILLAGE
WHEREAS, the President and Board of Trustees of the
Village of Elk Grove Village, by Ordinance 1138 and amended by
Ordinance Nos. 1354 and 1400, granted a Special Use Permit
to John and George Gullo to permit the construction of a
restaurant on property legally described hereinafter, conditioned
upon the adherence to a site plan therein contained; and
WHEREAS, the owners of said property have requested
that the President and Board of Trustees approve an amended
site plan, the revisions and changes of said amended site
plan being deemed a minor in nature; and
WHEREAS, the President and Board of Trustees of the
Village of Elk Grove Village, after having considered the
request of the owners, find and believe it to be in the best
interest of the Village that such site plan be amended:
NOW, THEREFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois, as follows:
Section 1: That Ordinance No. 1138, as amended by
Ordinance Nos. 1354 and 1400, granting a Special Use Permit to
John and George Gullo to permit the construction of a restaurant,
be and the same is hereby further amended by substituting therein
a revised site plan, a copy of which is attached hereto as
Exhibit "A" and incorporated herein, for property legally described
as follows:
Lot 249 in Higgins Industrial Park Unit No. 178,
being a subdivision in the South Half Section 27,
Township 41 North, Range 11, East of the Third
Principal Meridian in Cook County, Illinois.
lection 2: That a Special Use Permit amended by the
terms hereof is conditioned upon the following:
A. That railings be installed to protect the area
designated on the site plan as patio from vehicular traffic.
B. That parking stalls designated on said amended
site plan as stall nos. 36,37,38,39,40 and 41 be designated "compact,
cars only".
C. Such other changes as are depicted on the amended
site plan attached hereto.
Section 3: That the Village Clerk is hereby authorized
to publish the Ordinance in pamphlet form.
Section 4: That this ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.
