AN ORDINANCE AMENDING CHAPTER 24,
MISDEMEANORS AND OTHER OFFENSE BY ADDING
THERETO A NEW SECTION ENTITLED POSSESSION
OF CANNABIS
BE IT ORDAINED by the President and Board of Trustees of the
Village of Elk Grove Village, Cook and Du Page Counties, Illinois,
as follows:
Section 1: That Chapter 24, Misdemeanors and Other Offenses,
of the Municipal Code of the Village of Elk Grove Village, be and
the same is hereby amended by adding thereto the following:
24.047. Possession of Cannabis.
1. Definition. As used in this Section, Cannabis
includes marijuana, hashish and other substances
which are identified as including any parts of the plant
Cannabis Sativa, whether growing or not; the
seeds thereof, the resin extracted from any
part of such plant; and any compound, manufacture;
salt derivative, mixture, or preparation of such
plant, its seeds, or resin, including
tetrahydrocannabinol (THC) and all other cannabinol
derivatives, including its naturally occurring
or synthetically produced ingredients, whether
produced directly or indirectly by extraction or
independently by means of chemical synthesis or by
a combination of extraction and chemical synthesis;
but shall not include the mature stalks of such
plant, fiber produced from such stalks, oil or
cake made from the seeds of such plant, any
other compound, manufacture, salt, derivative,
mixture, or preparation of such mature stalks
(except the resin extracted therefrom), fiber,
oil cake, or the sterilized seed of such plant
which is incapable of germination.
2. It shall be unlawful for any person knowingly to
possess any quantity of Cannabis and it shall be
a violation of this Section to possess an amount
not exceeding 30 grams.
3. Any person violating any of the provisions of
this Section shall be subject to a fine of not
less than Twenty -Five ($25.00) Dollars, nor more
than Five Hundred ($500.00) Dollars for each
offense. Any subsequent conviction of a violation
of this Section within one (1) year from the date
of the first conviction shall render said person
subject to a fine of not less than One Hundred
($100.00) Dollars, nor more than Five Hundred
($500.00) Dollars.
Section 2: That this Ordinance shall be in full force and
effect from and after its passage, approval and publication according
to law.
