HomeMy WebLinkAboutORDINANCE - 1258 - 10/24/1978 - ZONING ORDINANCE AMENDEDORDINANCE NO. 1258 AN ORDINANCE AMENDING VARIOUS SECTIONS OF THE ELK GROVE VILLAGE ZONING ORDINANCE THEREBY ESTABLISHING AMBULATORY SURGICAL TREATMENT CENTERS AS A SPECIAL USE IN CERTAIN ZONED DISTRICTS WHEREAS, the Plan Commission of the Village of Elk Grove Village has held extensive public hearings to consider the question of establishing ambulatory surgical treatment centers as a permitted, conditional or a special use in any of the presently existing zoned districts of the Village; and WHEREAS, the Plan Commission has consulted with numerous expert witnesses, including a land planner and a doctor, said doctor being a member of the Ambulatory Surgical Treatment Center Board of the State of Illinois and a part-owner of an existing ambulatory surgical treatment center in Arlington Heights, Illinois; and WHEREAS, after reviewing the testimony of the expert witnesses, the Plan Commission has made a recommendation to the President and Board of Trustees that would establish ambulatory surgical treatment centers as a special use in all residential districts and in the O&T, Office/Transitional, District, subject to the terms and conditions hereafter set forth; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village reviewed the recommendation of the Plan Commission at a public hearing duly called and held according to law on October 17, 1978; and WHEREAS, the President and Board of Trustees, after having reviewed the recommendation of the Plan Commission, and after having conducted a public hearing, are of the opinion that establishing ambulatory surgical treatment centers as a special use, subject to certain conditions hereafter set forth, in all residential districts of the Village and the O&T, Office/Transitional, District, is in the best interests of the Village; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois, as follows: Section 1: That Section 9.12, Definitions, of the Zoning Ordinance of the Village of Elk Grove Village, be and the same is hereby amended by adding therein, in the applicable alphabetical location, the following definitions: (A). "Hospital" shall mean any institution, place, building, or agency, public or private, whether organized for profit or not, devoted primarily to the maintenance and operation of facilities for the diagnosis and treatment or care of two (2) or more persons admitted for emergency treatment or out-patient services or for overnight stay or: longer in order to obtain medical, including obstetric, psychiatric and nursing, care of illness, disease, injury infirmity or deformity. (B). "Ambulator Sur ical Treatment Center" shall mean any institution, place or building devoted primarily to the maintenance and operation of facilities for the performance of surgical procedures. Such facilities shall not provide beds or other accommodations for the overnight stay of patients. Ambulatory Surgical Treatment Centers do not include any institution, place or building devoted exclusively to the performance of dental or oral surgical procedures. (C). "Medical Clinic" shall mean a medical facility used for offices of more than one (1) doctor for the examination and treatment of patients, which doctors may be associated together or practicing independently of each other, while sharing the facilities and equipment therein, and shall not include a facility devoted primarily for the purpose of surgical procedures. Such facility shall not provide beds or other accommodations for the overnight stay of patients. Section 2: That Paragraph C, Office Uses, of Section 3.96, Parking Space Required, be amended by adding Ambulatory Surgical Treatment Centers to Paragraph 2 thereof, so that said Paragraph shall read as follows: (2). Medical and Dental Clinics,and Ambulatory Surgical Treatment Centers. One (1 parking space shall be provided for each one hundred fifty (150) square feet of floor area of building, plus one (1) space for each person, employee and professional or technical staff member on duty at any one time. Section 3: That Section 5.25, Special Uses in All Residential Districts, be and the same is hereby amended to read as follows: (A). Non-profit, public or private schools, churches, libraries, parks, recreational facilities, hospitals, and municipal buildings. (B). Ambulatory Surgical Treatment Centers in accordance with the following requirements: 1). Each Ambulatory Surgical Treatment Center shall be restricted to a free-standing building, which building shall exclude all retail uses, but shall permit medical offices and a pharmacy as permissible accessory uses of the Ambulatory Surgical Treatment Center. - 2 - 2). Each Ambulatory Surgical Treatment Center shall provide, as part of the building, a loading facility for the use of ambulances, which facility shall not be used for other vehicles. 3). Each Ambulatory Surgical Treatment Center shall provide an approved plan for vehicular ingress and egress, said approval to take the form of a certificate signed by the Chiefs of Police and Fire Departments and the Village Engineer, certifying that the plan for ingress and egress proposed by the user will not interfere with either highway or abutting users' traffic, or increase the risk to persons or property. 4). Each Ambulatory Surgical Treatment Center shall meet the requirements of Section 5.1, Dimensions, Bulk, and Area Regulations, for all zoning districts, as they apply to the O&T,Office/Transitional, Zoned District. Section 4: That Section 5.72, Uses Permitted, in the O&T, Office/ Transitional, District, be amended by deleting the word "hospitals" from Paragraph D of said Section 5.72, and by amending Paragraph E of Section 5.72 to read as follows: (E). Special Uses. Convalescent, Nursing Home, Rest Home, or Sanitarium - See Section 5.26(B). Child Care Nurseries. Hospitals. Ambulatory Surgical Treatment Centers in accordance with the following requirements: 1). Each Ambulatory Surgical Treatment Center shall be restricted to a free-standing building, which building shall exclude all retail uses, except as permitted in Section 5.72(A) above. 2). Each Ambulatory Surgical Treatment Center shall provide, as part of the building, a loading facility for the use of ambulances, which facility shall not be used for other vehicles. 3). Section 5: That this Ordinance shall be in full force and effect from and after its passage, approval and publication - 3 - according to law.
