HomeMy WebLinkAboutORDINANCE - 1277 - 2/13/1979 - FIRE PREVENTION/PENALTIESORDINANCE NO. 1277 AN ORDINANCE AMENDING ARTICLE III FIRE PREVENTION CODE OF CHAPTER 6 AND CHAPTER 24A SETTLEMENT OF PENALTIES OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the penalty provision of Section 6.312 be and the same be amended and renumbered to read as follows: Sec. 6.313 Penalty. Any person, firm or corporation violating any of the provisions of this Article shall be subject to a fine of not less than ten ($10.00) dollars nor more than five hundred ($500.00) for each offense, and a separate offense shall be deemed com- mitted on each day during or on which a violation or failure to comply occurs or continues. Section 2: That the paragraph entitled "Saving Clause and Ordinances Repealed" presently contained in Section 6.312 be deleted from Section 6.312 of the Municipal Code. Section 3: That Chapter 24A Settlement of Penalties, be and the same is hereby amended by adding thereto a new Article which shall read as follows: Article III Settlement of Fire Prevention Code Offenses. 24A.301 Authorization. The Fire Department of the Village of Elk Grove Village, through its duly appointed officers, inspectors and employees is hereby authorized to issue citations, notices to appear in court or com- plaints for violations of Chapter 6 of the Municipal Code of the Village of Elk Grove Village. 24A.302 Settlement. Any person, firm or corporation upon whom a citation or notice is served, except for those citations wherein a court appearance and a post- ing of bond is required, may elect to settle and com- promise the penalty arising from same by paying to the Village Clerk at the Village Hall the following settle- ment amounts: Final Notice Violation Due Date Penalty Date Penalty Chapter 6, Article III $10.00 $20.00 24A.303 Due Date - Final Notice Date. The due date for settlement of any of the above offenses shall be five (5) days from the date on which the citation or notice is served. The final notice date shall be five (5) days from the date on which said final notice is served. 24A.304 Sworn Complaint. In the event that the person, firm or corporation upon whom such cita- tion or notice to appear is issued fails to settle and compromise said claim within the prescribed time, or for violations relating to life safety provisions of the applicable fire prevention code which,in the opinion of the Fire Department require a Court appearance, the Fire Department officer, inspector or employee is authorized and directed to file a sworn complaint in the Circuit Court of Cook or DuPage County (as jurisdiction directs), charging the violator with the violation set forth on the citation above referred to. A copy of such complaint or summons shall be issued and served upon the defendant violator in a manner prescribed by law, setting forth a date, time and place such complaint shall be heard by the court. Section 4: This Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 6 NAYS: 0 ABSENT:O APPROVED: Charles J.
