AN ORDINANCE REZONING CERTAIN PROPERTY WITHIN
THE VILLAGE FROM R-3, RESIDENTIAL, TO A-2,
MULTI -FAMILY, AND GRANTING A SPECIAL USE PERMIT
FOR DEVELOPMENT OF THE PROPERTY AS A PLANNED
UNIT DEVELOPMENT (WINSTON GROVE SECTION 24)
WHEREAS, the Planning Commission of the Village of Elk Grove Village, has
conducted a public hearing duly called and held according to law to consider the
question of rezoning certain property legally described hereinafter from R-3,
Single-family Residential, to A-2, Multi -Family Residential, and of granting a
special use permit for the construction of a planned unit development; and
WHEREAS, the said Plan Commission has recommended the granting of the rezoning
and of the special use permit subject to certain conditions hereinafter set forth
and the President and Board of Trustees of the Village of Elk Grove Village, after
having considered the recommendation of said Planning Commission find and believe
it to be in the best interests of the Village that said property be rezoned and
that a special use be granted.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That the property legally described on Exhibit A attached hereto
and by this reference incorporated herein be and the same is hereby rezoned from
R-3, Single -Family Residential to A-2, Multi -Family Residential.
Section 2: That there be granted a special use permit to develope the above
described as a planned unit development subject to the following conditions:
1. That the subject property be developed in conformity with the final land
use and zoning plat entitled "Section 24 Townhouses" prepared by Henderson and
Bodwell dated March 1979, three copies of which are on file with the Village
Clerk of the Village of Elk Grove Village, which plat is hereby adopted by refer-
ence and incorporated herein.
2. Storm detention must be provided for the subject property. The storm
detention must comply with the applicable Village of Elk Grove Village and MSD
regulations and standards provided therefor and must be approved by the Village Engineer.
3. The owner shall create a public easement of at least fifteen (15) feet in
width along the south and east side of Salt Creek that abuts the proposed development.
4. Sidewalks will be constructed as required by the Village's Subdivision
Control Ordinance and shall be located in an area which is one (1) foot away from
the edge of the dedicated right-of-way and within said dedicated right-of-way.
5. The owner shall comply with all Village codes and ordinances in the devel-
opment of the subject property except that there shall be granted a variation of
Section 5.34 E 4 of the Zoning Ordinance and Section 3.54 B of the Zoning Ordinance
to permit the location of the structures as set forth on the final land use and
zoning plat incorporated herein.

6. The owner will provide a roadway which will connect the subject townhouse
area and the abutting single-family development which roadway shall be dedicated
to the Village and the location of which will be as set forth in the approved land
use and zoning plat.
7. The owner shall provide fifty (50%) percent common open space which open
space shall be owned and maintained by an association established by the owner.
The common open space shall be graded and seeded and shall be of a useable quality
to be used by the residents of the proposed development. The grading and seeding
shall be in conformity with the standards of the Elk Grove Park District provided
therefor and shall be reviewed and approved by the Village Engineer. The common
open space shall meet the Village Engineer's requirements for being in a useable
condition.
8. The total development shall consist of the following number of units:
A. Sixty-five (65) two bedroom townhouses (31.5%).
B. One Hundred Forty One (141) three bedroom townhouses (68.5%)
X 9. Owner shall provide a landscaping plan for the entire development, includ-
ing the common open space area. The landscaping plan shall be reviewed and approved
by the Plan Commission prior to the issuance of any occupancy permit.
10. Within the common open space, the owner shall provide a parcel which will
be two hundred (200) feet by three hundred (300) feet to be used by the residents
of the development for recreational activities. The above parcel will be fine
graded and seeded for organized recreational activities in accordance with the
standards of the Elk Grove Park District provided therefor. The location shall
be in close proximity to the recreational area as set forth on the final land use
and zoning plat.

Section 3: That the Village Clerk is hereby authorized to record a copy
of the final land use and zoning plat with the Recorder of Deeds of Cook County,
Illinois.
Section 4: That this ordinance shall be in full force and effect from and
after its passage, approval and publication according to law.
