HomeMy WebLinkAboutORDINANCE - 1360 - 3/25/1980 - HANDICAPPED PARKING PENALTYORDINANCE NO. 1360 AN ORDINANCE AMENDING ARTICLE V PARKING RULES OF CHAPTER 14 OF THE MUNICIPAL CODE BY PROVIDING HANDICAPPED PARKING REGULATIONS AND AMENDING THE GENERAL PENALTY PROVISIONS WHEREAS, the Village of Elk Grove Village is a home rule municipality as defined and set forth in the constitution of the State of Illinois and is authorized by said constitution to establish necessary regulations for the health, safety, and welfare of its residents; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village deem it to be in the best interest of the Village to provide for parking for the handicapped. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook and DuPage Counties, Illinois pursuant to its home rule authority as follows: Section 1: That Section 14.514 of Article V of Chapter 14 of the Municipal Code be and the same is hereby amended to read as follows: 14.514 Handicapped Parking A. It shall be unlawful for any person to park, stand or otherwise allow a vehicle to be in a stopped position in any parking area of the Village which has been designated and posted as a handicapped parking area. The provisions of this Section shall not apply to any.motor vehicle having an identification card on display in its windshield (which identification card declares the possessor thereof to be a handicapped person and which card has been issued by any of the Town- ships of the State of Illinois) or a motor vehicle bearing registration plates issued to a physically handicapped person pursuant to Section 3-616 or to a disabled veteran pursuant to Section 3-609 of the Illinois Vehicle Code. B. The owner or the agent or manager of the owner of any area wherein parking is provided who is desirous of reserving one (1) or more parking spaces for the use of the handicapped shall notify the Village of its intention to provide for same and request that the Village Police Department enforce the provisions of this Ordinance. C. All designated handicapped parking stalls shall be posted with signs approved by the Chief of Police and shall be purchased, installed and maintained by the owners of the property where said signs are located. D. The following areas are hereby designated as handicapped parking locations: Section 2: That Article V,Parking Rules, be further amended by adding thereto the following: 14.515 Penalty. Any person violating any of the provisions of this Article (except for Section 14-510) shall be subject to a fine of not less than Ten ($10.00) Dollars nor more than Two Hundred ($200.00) Dollars for each offense. Section 3: That Chapter 24A, Settlement of Penalties is hereby amended by substituting therein the following and deleting all provisions contrary thereto: - 2 - Section of the Municipal Settlement Code Violated Amount 14.501 thru 14.509 14.511 thru 14.514 $10.00 14.510A $15.00 Section 4: Any person, firm or corporation violating any of the provisions of this Ordinance shall be subject to a fine of not less than Ten ($10.00) Dollars nor more than Two Hundred ($200.00) Dollars for each offense. Section 5: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 4 NAYS: 0 ABSENT: 2 ATTEST: Fay M.
