HomeMy WebLinkAboutORDINANCE - 1384 - 7/8/1980 - ANNEXING & REZONE GARLISCH PROPERTYORDINANCE No. 1384 AN ORDINANCE ANNEXING AND REZONING CERTAIN PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE (GARLISCH) WHEREAS, a written petition has been filed with the Village Clerk of Elk Grove Village by Garlisch Equipment Sales, Inc.; the First National Bank of Des Plaines as Trustee under Trust No. 61021499 and Roselle State Bank & Trust Company as Trustee under Trust No. 1182,being the owners of record and the contract pur- chasers of the hereinafter described land and territory, said petition being for annexation to the Village of Elk Grove Village; and WHEREAS, said land and territory is not within the corporate limits of any municipality but is contiguous to the Village of Elk Grove Village. and has no electors residing thereon: and WHEREAS, all applicable provisions of the Illinois Revised Statutes concerning annexation have been fully complied with; and WHEREAS, the Planning Commission of the Village of Elk Grove Village has held pre -annexation hearings duly called and held according to law and as a result thereof, find and believe it to be in the best interest of the Village that such property be annexed to the Village of Elk Grove Village and be rezoned to the B-3 Business District; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, after having examined said petition to annex, and having examined the findings of the Planning Commission, and having held a public hearing duly cAlled and held according to law, considering the petition for annexation and the pre -annexation agreement find and believe it to be in the best interest of the Village that said land and territory be annexed to the Village of Elk Grove Village and rezoned to the B-3 Business District; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, as follows: Section 1: That the land and territory described in Exhibit - 2 - "A" attached ,ereto and incorporated herein, which territory is contiguous to the Village of Elk Grove Village, and is not within the .limits of any municipality, be and the same is hereby annexed to the Village of Elk Grove Village. Section 2: That said property shall upon annexation be zoned B-3 Business (Equipment Sales, Rental and Repair) so that hereafter said territory shall be included within the boundary lines and limits of said Village of Elk Grove Village, as is by law in such cases made and provided. Section 3: That said property is hereby annexed to the Village pursuant to a'pre-annexation agreement dated July 8th 1980, duly adopted and approved by the Village of Elk Grove Village by Resolution No. 69-80 passed and approved on the 8th day of July 1980, and that said annexation agree- ment is binding upon the petitioners and the Village of Elk Grove Village, and all vendees, assigns, and successors -in -interest. Section 4: That the Village Clerk of the Village of Elk Grove Village is hereby directed to record a certified copy of this Ordinance together with an accurate plat of annexation of said territory with the Recorder of Deeds of Cook County, Illinois, and is further directed to amend the zoning map of the Village in accordance with the provisions hereof and to file such notice of annexation as is required by law. Section 5: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication according to law. VOTES: ATTEST: AYES: 5 NAYS: 0 ABSENT: 1 APPROVED: Charles J.
