AN ORDINANCE GRANTING A VARIATION TO
THE FIRST NATIONAL BANK OF DES PLAINES
AS TRUSTEE UNDER TRUST NO. 61021499 AND
THE GARLISCH EQUIPMENT SALES, INC., TO
PERMIT AN EXISTING STRUCTURE TO REMAIN
WITHIN THE TWENTY-FIVE FOOT (25') FRONT
YARD SET -BACK LINE
WHEREAS, the Village of Elk Grove Village has pursuant
to Ordinance No. annexed certain property legally described
therein to the Village of Elk Grove Village, which property
contained existing structures which are located within the
twenty-five foot (25'1.front yard set -back line; and
WHEREAS, the owner of said property will by a final plat
of subdivision convey a twenty-five foot (25') easement on
said front yard area to the Village of Elk Grove Village for
rhe purpose of installation, repair and maintenance of public
utilities; and
WHEREAS, the President and Board of Trustees have held
a public meeting to consider the pre -annexation agreement,which
agreement included the granting of the variation provided for
herein;
NOW, THEREFORE, BE IT ORDAINED, by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois, as follows:
Section 1: That there be granted a variation of the twenty-
five foot (25') front yard requirement to permit the existing
structure to remain in its present location on property legally
described on Exhibit "A" attached hereto and incorporated herein.
Section 2: That the Village of Elk Grove Village hereby
agrees that upon the dedication of a twenty-five foot (25') front
yard easement to the Village for the installation, repair and
maintenance of public utilities, the Village will not utilize
said easement rights in any manner that will infringe on that
portion of the easement area on which the existing structure is
located.
Section 3: That this Ordinance s'Zall be in full force
and effect from and after its passage, approval and publication
according to law.
