HomeMy WebLinkAboutORDINANCE - 1313 - 6/26/1979 - ZONING VARIATION/HIGGINS & ARL HTS RDORDINANCE NO. 1313 AN ORDINANCE GRANTING THE VARIATION OF THE ZONING ORDINANCE OF THE VILLAGE TO SHELL OIL TO PERMIT THE CONSTRUCTION OF A CANOPY, WHICH WOULD EXTEND 15 FEET INTO THE 25 FOOT REQUIRED FRONT YARD AT THE SOUTHEAST CORNER OF HIGGINS ROAD AND ARLINGTON HEIGHTS ROAD, ELK GROVE VILLAGE WHEREAS, the Zoning Board of Appeals at a public meeting duly called and held considered the question of granting a variation of the Zoning Ordinance to permit the construction of a canopy which would extend into the required front yard to the Shell Oil Company; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, after having considered the recommendation of said Zoning Board not to grant said variation, find and believe that the Petitioner has established such a hardship as to entitle the Petitioner to the granting of said requested variation; NOW,THEREFORE,BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a variation of Section 5.1, dimensions, bulk and area regulations for all zoning districts and Section 3.54e, of the Zoning Ordinance of the Village of Elk Grove Village to permit the construction of a canopy, which would extend 15 feet into the 25 foot required front yard to the Shell Oil Company for property located at the southeast corner of Higgins Road and Arlington Heights Road and legally described on Exhibit A attached hereto and incorporated herein. Section 2: This Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
