AN ORDINANCE ANNEXING AND REZONING
CERTAIN PROPERTY TO THE VILLAGE OF
ELK GROVE VILLAGE (BONDIOLI)
WHEREAS, a written petition has been filed with the Village
Clerk by the O'Hare International Bank as Trustee under Trust No.
711,148, being the owner of record of the hereinafter described land
and territory, said petition being for annexation to the Village of
Elk Grove Village; and
WHEREAS, said land and territory is not within the Corporate
Limits of any municipality, but is contiguous to the Village of Elk
Grove Village, and has no electors residing thereon; and
WHEREAS, all applicable provisions of the Illinois Revised
Statutes concerning annexation have been fully complied with including
notice to any fire protection district, library district, township
road commissioner or any other entity entitled to receive same; and
The Plan Commission of the Village of Elk Grove Village, acting
as a Zoning Commission, has held preannexation hearings, to be called
and held according to law, and as a result thereof, find and believe
it to be in the best interests of the Village that such property be
annexed to the Village and be granted such zoning as is hereinafter
set forth; and
WHEREAS, the President and Board of Trustees of the Village of
Elk Grove Village after having examined the findings of the Plan Commission,
and having held a public hearing duly called and held according to law
considering the petition for annexation, find and believe it to be in
the best interest of the Village that said land and territory be annexed
to the Village of Elk Grove Village;
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and Du?age,
Illinois as follows:
Section 1: That the land and territory described in Exhibit A
of an Annexation Agreement dated the
24th
day of July
1979, by and between the Village of Elk Grove Village
and the petitioner herein, a copy of said Annexation Agreement being
attached hereto and incorporated herein, which territory is contiguous
to the Village of Elk Grove Village, and is not within the limits of any
municipality, be and the same is hereby annexed to the Village of Elk
Grove Village.
Section 2: That parcel 1 of Exhibit C of the above described
Annexation Agreement is hereby granted I-1 Restricted Industrial Zoning
and the parcel 2 as legally described on said Exhibit C is hereby
granted B-3 Business (automotive) Zoning so -hat hereafter said territory
shall be included within the boundary lines and limits of said Elk
Grove Village, as is by law in such cases made and provided.
Section 3: That said property is hereby annexed to the Village
pursuant to the attached Annexation Agreement dated July 24th , 1979,
and that said Annexation Agreement is binding upon the petitioners and
the Village of Elk Grove Village, and all vendees, assigns and
successor -in -interest.
Section 4: That the Village Clerk of the Village of Elk Grove
Village is hereby directed to record a certified copy of this Ordinance
together with an accurate Plat of Annexation of said territory with
the Recorder of Deeds of Cook County, Illinois, and is further directed
to amend the Zoning Map of the Village in accordance with the provisions
hereof.
Section 5: That the Village Clerk is hereby directed to publish
this Ordinance in pamphlet form.
Section 6: That this Ordinance shall be in full force and effect
from and after its passage, approval and publication according to law.
