AN ORDINANCE AMENDING ARTICLE VII
TAG DAYS OF CHAPTER 23 OF THE
MUNICIPAL CODE BY PROVIDING FOR
AND REGULATING ON STREET SOLICITATION
WHEREAS, the General Assembly of the State of Illinois by
virtue of the adoption of public act 81-29 duly approved on the
21st day of June, 1979, has prohibited the soliciting of contributions
from the occupant of any vehicle except within a municipality when
expressly permitted by Municipal Ordinance; and
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove find and believe that such solicitation and the dollars
raised therefrom provides a great benefit to the residents of the
Village and society as a whole;
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois as follows:
Section 1: That Article VII Tag Days of the Municipal Code
of the Village of Elk Grove Village be and the same is hereby
amended so as to read as follows:
Article VII Tag Days/On Street Solicitation
23.701 Permit required.) It shall be unlawful for any person,
firm or corporation to publicly solicit, either in person or by
agent upon the streets or other public place in the Village,
subscriptions for charitable or religious or educational or other
organizations or purposes, without having first secured a permit
therefor.
23.702 Application.) Application for such permits shall be
made to the Village Clerk and shall set forth: the full name and
address of the applicant or applicants, the day or days requested
for such permit and such other information which the Village Clerk
shall deem necessary.
23.703 On Street Solicitation.) Solicitation on highways
within the Village shall be allowed only at intersections where
all traffic is required to come to a full stop. The soliciting
agency shall be:
1. Registered with the Attorney General as a charitable
organization as provided by "An Act to regulate solicitation
and collection of funds for charitable purposes, providing
for violations thereof, and making an appropriation therefor",
approved July 26, 1963, as amended;
2. Engaged in a Statewide fund raising activity; and
3. Liable for any injuries to any person or property
during the solicitation which is causally related to an act
of ordinary negligence of the soliciting agent.
Any person engaged in the act of solicitation shall be 16
years of age or more and shall be wearing a high visibility
vest.
23.704 Penalty.) Any person, firm or corporation violating
any provision of this article shall be fined not less than $10.00
nor more than $100.00 for each offense.
Section 2: That this Ordinance shall be in full force and
effect from and after its passage, approval and publication
according to law.
