HomeMy WebLinkAboutORDINANCE - 3809 - 4/25/2023 - JURISDICTIONAL TRANSFER BETWEEN IDOT AND EGV-MIDWAY COURTORDINANCE NO. 3809 AN ORDINANCE APPROVING JURISDICTIONAL TRANSFER BETWEEN THE ILLINOIS DEPARTMENT OF TRANSPORTATION AND THE VILLAGE OF ELK GROVE VILLAGE (ADDENDUM #2) WHEREAS, the Village of Elk Grove Village ("VILLAGE"), Cook and DuPage Counties, Illinois, and the State of Illinois ("STATE"), through its Department of Transportation, seek to enter into an agreement for the jurisdictional transfer of Midway Court (IDOT key Route 016 06011 001735 (Station 0.00 to 3.0)) from the STATE to the VILLAGE. A location map identifying the limits of the jurisdictional transfer is attached hereto as Exhibit #1; and WHEREAS, the STATE and the VILLAGE entered into an agreement for transfer of jurisdiction of Midway Court from the northeast edge of pavement of Higgins Rd. (IL 72) northeast and then southeast to the end of the road (cul de sac), in its entirety, to the VILLAGE system; and WHEREAS, the Mayor and Board of Trustees find and declare that it is in the best interests of the VILLAGE to approve the Jurisdictional Transfer Agreement attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, counties of Cook and DuPage, Illinois that Midway Court be added to the municipal street system, as follows: Section 1: The recitals set forth hereinabove shall be and are hereby incorporated as findings of fact as if said recitals were fully set forth herein. Section 2: The Jurisdictional Transfer Agreement attached hereto shall be, and is hereby approved, and the Mayor is hereby authorized and directed to execute, and the Village Clerk is hereby authorized and directed to attest said Agreement as attached. Section 3: This Ordinance shall be in full force and effect from and after it passage and approval in the manner provided by law. Section 4: All ordinances or parts of ordinances in conflict herewith shall be and the same are hereby repealed. Section 5: The Village Clerk of the Village of Elk Grove Village shall certify to the adoption of this ordinance and cause the same to be published in pamphlet form. WHEREAS, the authority to enter into this contract is Granted the STATE by Section 4-409 of the Illinois Highway Code and the authority to make changes in the State Highway System is granted the STATE under section 2-101 of the Illinois Highway Code. Include for Municipalities Only WHEREAS, the authority to make changes to the Municipal Street System is granted to the Municipality by Section 7-101 of the Illinois Highway Code. For more information see Chapter 5 of the Bureau of Local Roads and Street Manual (BLRS Manual). For signature requirements, refer to Chapter 2, Section 3.05(b) of the BLRS Manual. Is this form part of an agreement? Check Yes if the form is being included with a written agreement between the State and LPA as an exhibit. If the form will not become part of a written agreement as an exhibit, check No. If the wrong box is selected, the form will need to be closed and reopened. Exhibit (if applicable) Insert the exhibit number based on any other exhibits included in the agreement that this document is attached to. Local Public Agency Insert the name of LPA involved in the jurisdictional transfer. LPA Type Select LPA Type of the Local Public Agency (i.e. County, Municipality, Township/Road District) County Insert the name of the county in which the LPA is located. Section Number If an improvement is involved, the section number of the project should be inserted. If a present worth jurisdictional is involved, the section number should end in "JT". Type of Systems Transfer Only one box can be checked: Type 1 Check this box if the transfer is from the State Highway System to the Local Highway System. Type 2 Check this box if the transfer is from the Local Highway System to the State Highway System. LoCa W- De=1lion Road Name Insert the road (common) name of the roadway involved in the transfer. Route Insert the route number of the roadway involved in the transfer. Key Route Information Insert the key route(s) number of the roadway involved in the transfer. This information will need to be obtained from the Department of Transportation. This will be a 14 digit code. Length Insert the length of the transfer in miles to the nearest hundredth. Termini Insert the beginning and ending termini of the transfer. When describing the limits of the jurisdictional transfer the wording of the termini description should be consistent between the agreement itself and any ordinances, or resolutions that may be included with the agreement. If more lines are needed please add on an additional piece of paper as an addendum. Structure Transfer Check the appropriate box as to the status of the transfer of any NBIS structures located within termini of the roadway transfer. List structures on the line provided. If no structure exists then insert N/A on the line. Any structure not specifically excluded is considered part of the jurisdictional transfer. If there is not enough room to add all structures, attach a separate piece of paper with the list as an addendum. Land Rights Transfer Check the appropriate box as to the status of transfer of land rights if any. Include the approved letter of intent from the Department of Transportation if land rights are begin transferred. Effective Jurisdictional Transfer Date Check the appropriate box as to when the jurisdictional transfer will become effective. If the Final Inspection By State box is checked, indicate type A (Form BC-71, Final Inspection Report of State Road Work) or type B (Report of Final Inspection). Attachments Attach a location map of the jurisdictional transfer roadway as Addendum No. 1, and a resolution or ordinance as Addendum No. 2 (if applicable, along with any other support documentation as required attachments).
