AN ORDINANCE EXERCISING THE VILLAGE'S HOME RULE
AUTHORITY TO CONVEY REAL ESTATE BY PRIVATE
NEGOTIATION A14D CONTRACT
WHEREAS, the Village of Elk Grove Village is a home rule unit
by the virtue of the provisions of the Constitution of the State of
Illinois of 1970; and
WHEREAS, the Village, as a home rule unit, may exercise any power
and perform any function pertaining to its government and affairs,
including the power to convey real estate; and
WHEREAS, Section 11-76-1 and Section 11-76-2 of the Illinois
Municipal Code authorize the corporate authorities of municipalities
to sell municipal property pursuant to ordinance after the solicitation
of bids; and
WHEREAS, the President and Board of Trustees does hereby determine
that it is empowered by the Constitution of the State of Illinois of
1970 to sell real estate owned by the Village as a function pertaining
to its government and affairs, by private contract and negotiation,
and further that it is advisable and necessary and for the best
interests of the Village to be empowered with the right to sell by
private sale.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
Du Page, Illinois.
Section 1: That the Corporate Authorities of the Village of
Elk Grove Village shall have the express power to sell and convey real
estate owned by the Village by contract or by a negotiated private
sale, and that any such contract has to be approved by a vote of
two -third's (2/3rd's) of the Corporate Authorities present and voting
at the time such contract is approved.
Section 2: That the Village Manager is hereby directed and
authorized to enter into negotiations with prospective purchasers of
property, the sale of which the President and Board of Trustees deem
to be in the best interests of the Village.
Section 3: That this Ordinance shall be in full force and effect
from and after its passage, approval and publication according to
law.
