AN ORDINANCE ANNEXING AND REZONING CERTAIN
PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE
(GULLO)
WHEREAS, a written petition has been filed with the Village
Clerk of Elk Grove Village by John Gullo and Maria Gullo, his wife,
George Gullo and Sarah Gullo, his wife, Amalgamated Trust and Savings
Bank, as Trustee, under Trust No. 2366, John Rogowski and Lyndia
Rogowski, his wife, and The Bank and Trust Company of Arlington Heights,
as Trustee, under Trust No. 785, being the owners of record of the
hereinafter described land and territory, said petition being for
annexation to the Village of Elk Grove Village; and
WHEREAS, said land territory is not within the Corporate Limits
of any muncipality, but is contiguous to the Village of Elk Grove
Village, and has no electors residing thereon; and
WHEREAS, all applicable provisions of the Illinois Revised
Statutes concerning annexation have been fully complied with; and
WHEREAS, the Plan Commission of the Village of Elk Grove Village,
acting as a zoning commission, has held pre -annexation hearings, duly
called and held according to law, and as a result thereof, find and
believe it to be in the best interests of the Village that such
property be annexed to the Village of Elk Grove Village; and
WHEREAS, the President and Board of Trustees of the Village of
Elk Grove Village, Counties of Cook and Du Page, Illinois, after
having examined said petition to annex, and having examined the findings
of the Plan Commission, and having held a public hearing duly called
and held according to law considering the petition for annexation,
find and believe it to be in the best interests of the Village that
said land and territory be annexed to the Village of Elk Grove Village;
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
Du Page, Illinois, as follows:
Section 1: That the land and territory described in Exhibit A
of an Annexation Agreement dated the 27th day of January, 1978, by and
between the Village of Elk Grove Village and the petitioners herein,
a copy of said Annexation Agreement being attached hereto and
incorporated herein, which territory is contiguous to the Village of
Elk Grove Village, and is not within the limits of any municipality,
be and the same is hereby annexed to the Village of Elk Grove Village.
Section 2: That that portion of Exhibit A entitled "To Be Zoned
I-1, Restricted Industrial District" shall retain its I-1 legal
description as set forth on the Comprehensive Plan of the Village
of Elk Grove Village, and that portion of Exhibit A, which is entitled
"To Be Zoned O -T, Office Transitional District" is hereby granted O -T
Office Transitional District zoning, so that hereafter said territory
shall be included within the boundary lines and limits of said Elk
Grove Village, as is by law in such cases made and provided.
Section 3: That said property is hereby annexed to the Village
pursuant to the attached Annexation Agreement dated January 27, 1978,
and that said Annexation Agreement is binding upon the petitioners
and the Village of Elk Grove Village, and all vendees, assigns and
successors -in -interest.
Section 4: That the Village Clerk of the Village of Elk Grove
Village is hereby directed to record a certified copy of this Ordinance
together with an accurate Plat of Annexation of said territory with
the Recorder of Deeds of Cook County, Illinois, and is further directed
to amend the Zoning Map of the Village in accordance with the provisions
hereof.
Section 5: That this Ordinance shall be in full force and effect
from and after its passage, approval and publication according to law.
