AN ORDINANCE ANNEXING CERTAIN PROPERTY TO
THE VILLAGE OF ELK GROVE VILLAGE (SCHMIDT
WHEREAS, a written petition has been filed with the Village
Clerk of the Village of Elk Grove Village by Robert F. Schmidt and
Frank R. Stape Builders, Inc., being the record owner, and contract
purchaser, of the hereinafter described land and territory, said
petition seeking annexation to the Village of Elk Grove Village; and
WHEREAS, said land and territory is not within the Corporate
Limits of any municipality, but is contiguous to the Village of
Elk Grove Village and has three (3) electors residing thereon, all
of which have joined in said petition.
WHEREAS, any fire protection district, library district, or
other entity or person entitled to'notice prior to annexation of the
subject property has been given notice as is required by law; and
WHEREAS, all other statutory requirements in reference to the
annexation have been fully complied with, and the President and Board of
Trustees of the Village believe it to be in the best interest of
the Village that said land and territory be annexed thereto;
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Cook and Du Page
Counties, Illinois, as follows:
Section 1: That the land and territory shown and legally
described on Exhibit A attached hereto (which Exhibit A is a Plat of
Annexation), and by this reference made a part of this Ordinance,
which territory is contiguous to the Village of Elk Grove Village,
and not within the limits of any other municipality, be and the
same shall, pursuant to the provisions hereof, be annexed to the
Village of Elk Grove Village, so that said territory shall be included
within the boundary limits of said Village as is by law in such cases
made and provided.
Section 2: That upon the annexation of the property described
in Exhibit A, pursuant to the provisions hereof, the Pre -Annexation
Agreement applicable to such property, which Agreement was heretofore
approved by the President and Board of Trustees pursuant to
Resolution No. 68-78 , shall be in full force and effect,
provided that such Pre -Annexation Agreement has been signed by all
necessary parties other than the Village President and Village
Clerk, prior to October 3, 1978.
Section 3: That if all necessary parties to such Pre -
Annexation Agreement, other than the Village President and Village
Clerk, have not signed such Agreement on or before October 3, 1978,
then this Ordinance and the Resolution approving such Pre -Annexation
Agreement shall be null and void.
Section 4: That if all necessary parties, other than the
Village President and Village Clerk, sign the Pre -Annexation Agreement
on or before October 3, 1978, then the Village President and
Village Clerk shall sign such Agreement for and on behalf of the
Village of Elk Grove Village and upon such occurrence said property
shall be annexed to the Village of Elk Grove Village, and said
property shall be included within the boundary limits of said Village
as is by law in such case made and provided.
Section 5: That upon the annexation of said property, same
shall be zoned R-3, Residential, which zoning is the classification
ascribed to such property upon the Official Map of the Village.
Section 6: That, upon the annexation of such property,
pursuant to the provisions hereof, the Village Clerk shall record
a certified copy of this Ordinance, together with Exhibit A attached
hereto with the Recorder of Deeds of Cook County, Illinois.
Section 7: That this Ordinance shall be in full force and
effect on October 3, 1978, provided the Pre -Annexation Agreement
applicable to such property has been signed by all necessary parties
and after its passage and approval according to law.
