AN ORDINANCE AMENDING CHAPTER 18 LICENSES OF
THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE
VILLAGE PERTAINING TO MOTION PICTURE THEATERS
AND THEATRICALS AND GENERAL ENFORCEMENT PROVISIONS
WHEREAS, the Village of Elk Grove Village is a home rule muni-
cipality as defined and authorized by the Constitution of the State of
Illinois; and
WHEREAS, this Ordinance is adopted by the Village as a home rule
unit pursuant to the authority as set forth in said Constitution; and
WHEREAS, the President and Board of Trustees of the Village of
Elk Grove Village deem the provisions of this Ordinance to be an emer-
gency to the extent that the provisions of this Ordinance shall come
into immediate effect upon its passage and approval as provided by law.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois, as follows:
Section 1: That Article 9 Motion Picture Theaters and Theatricals
of Chapter 18 of the Municipal Code of the Village of Elk Grove Village
be and the same is hereby amended by adding to Section 18.904 Regulations
the following:
(d) It shall be unlawful to permit smoking in any part
of the premises except for designated smoking areas
approved by the Village Fire Department.
(e) Each theater licensed hereunder must be equiped
with separate washroom facilities for female and male
patrons, which facilities must be kept in a clean and
sanitary condition at all times.
Section 2: That Article 9 of Chapter 18 of the Municipal Code be
further amended by adding thereto the following section:
18.906 Owner/Manager On Duty. At all times when the
premises are open for business, the owner or a desig-
nated manager must be on duty to insure compliance
with all applicable regulations and provisions of this
Article and of the Municipal Code. Any such manager
appointed by the owner shall be twenty-one (21) years
of age or older and the name and address of any such
manager shall be filed by the owner with the Village
Clerk.
Section 3: That Section 18.5101 Penalties of Article LI Enforcement
Provisions be and the same is hereby amended by adding thereto the
following paragraph:
In addition to any penalties provided for herein, the
Village shall have the right to proceed by injunction
in the Third District Branch of the Circuit Court of
Cook County, Illinois to enjoin the operation of any
business which is operating without a license as re-
quired herein or which is operating in violation of
the applicable regulations and ordinances of the
Village and the continuous operation of which is likely
to be injurious to the health, welfare and wellbeing of
the occupants or patrons of said business establishment.
Section 4: That any person, firm or corporation violating any
of the provisions of this Ordinance shall be subject to a fine of not
less than Twenty -Five ($25.00) Dollars or more than Five Hundred ($500.00)
Dollars for each offense; and a separate offense shall be deemed commited
on each day during or on which a violation occurs or continues.
Section 5: That this Ordinance shall become effective immediately
upon its passage and approval and the Village Clerk is hereby authorized
to publish this Ordinance in a newspaper in general circulation in the
area.
