HomeMy WebLinkAboutORDINANCE - 1162 - 7/12/1977 - SIGNS & AWNINGS/AMENDEDORDINANCE NO. 1162 AN ORDINANCE AMENDING CHAPTER 12, SIGNS AND AWNINGS OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook and Du Page Counties, Illinois, as follows: Section 1: That Paragraph D, Permit Fees, of Section 12.001 of the Municipal Code, be and the same is hereby amended to read as follows: D. Permit Fees. Every applicant before being granted an original permit hereunder shall pay to the Village the following permit fee for each sign structure. (1). Non -Illuminated Signs - $15.00 plus $0.15 per square foot of sign surface area of the proposed sign. (2). Illuminated Signs - $25.00 plus $0.15 per square foot of sign surface area of the proposed sign. (3). Temporary Signs - $10.00, except that no permit fee shall be charged for temporary signs or for nameplates or for other non -illuminated identification signs permitted to be placed in residential use districts in this Article. Section 2: That Paragraph F, Annual Inspection Fees, of Section 12.001 of the Municipal Code, be and the same is hereby amended to read as follows: F. Annual Inspection Fees. The Building Department shall inspect annually, or more frequently as they deem necessary, signs in all districts located above any walkway or which may endanger passers-by upon any walkway on which the public is invited or encouraged to pass and all free-standing signs wherever located. To meet the expense of such inspections, the sign owner or permitee thereof shall pay to the Village the sum of one-half of the then required permit fee. No inspection fee, except for temporary banner and pennant signs shall be charged during the fiscal year in which the sign or other advertising device is erected. An inspection fee of $5.00 per month shall be charged for temporary banner and pennant signs to be erected for a period in excess of 30 days or fraction thereof. Section 3: That Section 12.001, Permits Required, of the Municipal Code, be further amended by adding thereto a new paragraph which shall read as follows: G. Exempt Signs. Signs which provide direction or instruction and are located entirely on the property to which they pertain and do not in any way advertise a business and do not exceed four square feet in area; signs identifying restrooms, public telephones and walkways; and signs providing direction such as parking lot entrance and exit signs and those of a similar nature are exempt from the provisions of this Ordinance, except that such signs must comply to the line of sight provisions of Section 12.004(D) of this Chapter. Section 4: That Paragraph X, Temporary Signs, of Section 12.002, Definitions, of the Municipal Code, be and the same is hereby amended to read as follows: X. "Temporary Sign" shall mean any banner or pennant constructed of cloth or similar material without a structural frame. The total area of a temporary sign shall not exceed the allowable area of permitted wall signs. Section 5: That Section 12.002, Definitions, of the Municipal Code, be further amended by adding thereto a new paragraph entitled Incidental Signs which shall read as follows: BB. "Incidental Signs" shall mean a sign pertaining to goods, products, services or facilities which are available on the premises where the sign is located, such as signs pertaining to trading stamps, credit cards, service information and pricing. Section 6: That Paragraph B, Signs in the B-1, B-2 and B-3 Business District, of Section 12.003, of the Municipal Code, be and the same is hereby amended by adding thereto the following: 8. Incidental Signs. In the B-3 Business District, up to two incidental signs may be permitted subject to the requirement that they be attached to a free-standing sign or attached to a separate structure, that they comply with the line of sight provisions of Section 12.004(D) of this Chapter and that they not exceed five square feet per face. Section 7: That Section 12.004(D) is hereby amended by adding thereto a second paragraph which shall read as follows: No sign which obstructs sight lines at elevations between two and six feet above the roadway shall be placed or permitted to remain on any corner lot within the triangular area formed by the street property lines and a line connecting them at points 25 feet from the intersection of the street lines, or in the case of a rounded property corner, from the intersection of the street property lines extended. The same sight line limitations shall apply on any interior lot within the triangular area formed by the - 2 - street property line and the edge of the driveway and the line connecting them at points 10 feet from the intersection of the property line and the driveway. Section 8: That Section 12.004(L), Temporary Signs, is hereby amended to read as follows: L. Temporary Signs as defined in Chapter 12.002(X) shall be permitted subject to thefollowing conditions: (1). Temporary signs shall be installed completely on private property and comply with the line of sight provisions of Section 12.004(D) hereof. (2). Approval of the President and Board of Trustees for all pennants and banners to be displayed for a period in excess of 30 days. (3). Evidence of a maintenance agreement whereby all pennants and banners displayed for more than 30 days shall be regularly maintained. Such maintenance shall be performed at not less than 30 day intervals. Section 9: That any person, firm or corporation who violates any of the provisions of this Ordinance shall be subject to a fine of not less $25.00 nor more than $200.00 for each offense, and a separate offense shall be deemed committed on each day, commencing from date of official notification during or on which a violation or failure to comply occurs or continues. Section 10: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 4 NAYS: 0 ABSENT: 2 ATTEST: Eleanor G.
