AN ORDINANCE AMENDING SECTION 14.337A-1,
14.337A-2 AND 14.338 OF THE MUNICIPAL CODE
OF THE VILLAGE OF ELK GROVE VILLAGE PERTAINING
TO WEIGHT RESTRICTIONS FOR VEHICLES ON
OAKTON STREET AND LANDMEIER ROAD
WHEREAS, the Village of Elk Grove Village currently regulates.the
weight on Oakton Street and Landmeier Road pursuant to Section 14.337A-1
of the Municipal Code; and
WHEREAS, it is the position of the Village that said Section is
valid and enforceable, but that certain confusion has existed as to the
nature of vehicles being regulated and the penalty for a violation thereof;
and
WHEREAS, it is vital to the maintenance of the Village streets
that these regulations remain uninterrupted and in full force and
effect and that, therefore, an emergency exists requiring this Ordinance
to be effective immediately upon its passage and approval; and
WHEREAS, the adoption of this Ordinance is to merely clarify the
coverage of the existing Ordinance.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page,
Illinois, as follows:
Section 1: That Section 14.337A of the Municipal Code be and the
same is hereby amended to read as follows:
14.337A. It shall be unlawful for any person to
operate a motor vehicle, except a public passenger vehicle,
in excess of five (5) tons on any street or road in the Village
except the following:
a. All streets lying south of Landmeier Road and east of
Tonne Road.
b. All streets lying east of Busse Road.
C. All streets lying north of Higgins Road.
d. Higgins Road, Arlington Heights Road (also known
as State Road), Biesterfield Road, Devon Avenue
and Rohlwing Road.
Section 2: That Section 14.337A-1 of the Municipal Code be and
the same is hereby amended to read as follows:
14.337A-1. It shall be unlawful for any person to
operate a motor vehicle, except a public passenger vehicle
in excess of twelve (12) tons on Oakton Street between
Arlington Heights Road and Kent Avenue, and on Landmeier
Road between Arlington Heights Road and Tonne Road.
Section 3: That Section 14.337A-2 of the Municipal Code be and
the same is hereby amended to read as follows:
14.337A-2. Any person, firm or corporation violating
Section 14.337A or 14.337A-1 shall be fined an amount equal
to:
Two cents ($.02) per pound for each pound
of excess weight when the excess exceeds
1,000 pounds and is 2,000 pounds or less;
Four cents ($.04) per pound for each pound
of excess weight when the excess exceeds
2,000 pounds and is 3,000 pounds or less;
Six cents ($.06) per pound for each pound
of excess weight when the excess exceeds
3,000 pounds and is 4,000 pounds or less;
Eight cents ($.08) per pound for each pound
of excess weight when the excess exceeds
4,000 pounds and is .5,000 pounds or less;
and
Ten cents ($0.10) per pound for each pound
of excess weight when the excess exceeds
5,000 pounds.
Section 4: That Section 14.338, Limited Load Streets, be and the
same is hereby amended to read as follows:
14.338. Limited Load Streets. Whenever the weight of
vehicles permitted on a street is limited by Ordinance and
signs indicating such limitations are posted, it shall be
unlawful to operate a vehicle in excess of such weight on such
street, except for the purpose of making a delivery or picking
up a load and where it is impossible from the location of the
building or the kind or character of the freight or goods to
be received or delivered, to receive or deliver the freight or
other goods or merchandise from a side -street, or a street
other than the streets regulated in 14.337A -or 14.337A-1 herein,
in which case such vehicles shall be permitted to enter such
street at the cross -street nearest said building or premises,
and receive or deliver such freight or other goods, but shall
not thereafter proceed further on such street than the nearest
cross -street.
Section 5: That the subject matter of this Ordinance is hereby
declared to be an emergency matter and that this Ordinance shall be
immediately effective upon its passage and approval according to law.
